Does him having resigned change things? Sounds like he’s arguing that he was certain he was being railroaded and was inevitably going to be fired, but I’d imagine that even if true not letting the process play out might hurt his case.

It appears that you don’t have to worry *too* much about refrigeration even, since it’s a quality issue not a food safety risk. They’re far more emphatic about not leaving it in the can after you’ve opened it…
