![Require the ICO to consider the merits of data protection complaints
Reform the Data Protection Act to require the Information Commissioner to reach decisions on data protection complaints on the basis of the merits of the complaint, not merely to record a complaint and procedurally respond.
Data subjects have a right to complain to the ICO when they consider their personal data rights to have been infringed. However, under the Data Protection Act 2018 as interpreted by Delo [2023] EWCA Civ 1141, the ICO has no obligation to investigate complaints' merits whatsoever, and can pick who it wants to enforce against.
