UPDATE: Judge April Perry denies the government's bid to keep all of this under seal — including the attorney's signature block. "The government has also publicly disclosed … that there is an OPR investigation in this case."
MINUTE entry before the Honorable April M. Perry: The Government's motion to seal 275 is denied. As already noted, the grand jury transcripts in this matter have already been made public - without any opposition from the Government. The Government has also publicly disclosed - in both court filings and open court - the fact that there is an OPR investigation in this case involving the prosecutors who were in the grand jury. See, e.g., Doc. 247 at 48-49. In addition to those two matters, the Government has also asked to seal the "Legal Principles" section of its motion, which sets forth basic principles of law, and the signature block of one of its attorneys. There is a presumption that materials that underpin a judicial decision are open to public inspection unless they meet very specific criteria. See Baxter Intern., Inc. v. This is a big deal. DC fed judge says that DOJ's pursuit (and use) of the state voter files is unlawful, on a bunch of different grounds. And effectively confirms that for the 18 states that submitted files willingly, whoever collected the files at DOJ Civil Rights committed federal crimes.

Well, filing two paragraphs that they sign is easier than getting someone at DHS to agree to sign and then to agree to language, I’d imagine? Caveat, of c, that if the judge said to do that you do it, but I don’t think it’s inexplicable enough to be “bizarre.” It’s just not the order.

If they actually are "working collaboratively" and there are real efforts to get this person back, then the lawyers probably aren't going to complain about this — because they want their client back in the U.S. Nonetheless, there's a reason the judge ordered what he did. And this isn't that.

These guys in the U.S. Attorney's Office in Arizona think a judge's order is a suggestion. On the left is Judge Hinderaker's 10/6 order in the case of a gay man the Trump admin sent to Equatorial Guinea, where he has faced beatings and threats to his life. On the right is all that DOJ filed today.

Within three (3) days of the date of this Order, and every seven (7) days thereafter until Plaintif's return to the United States or further order of the Court, Defendants must file a status report, supported by a declaration from an official with personal knowledge, stating: (a) the information known to Defendants about Plaintiff's current location, custodial status, and physical condition; (6) the steps Defendants have taken since the prior report to comply with paragraph 5; and (c) the further steps Defendants intend to take and the anticipated timeline. This is, to be clear, a minimal “process” being put in place to try and meet the requirements of due process that they believe a majority of the Supreme Court would decide is sufficient should Trump decide, again, to try and fire Cook.

Under Trump’s order, a post-hearing filing is due from Cook by Nov. 10, so don’t expect an effort to actually fire her on Nov. 5. Worryingly for its own reasons of another agency’s independence and credibility, the new committee is to include the chair of the EEOC, currently Andrea Lucas.

The Navy board of inquiry literally wrote in its report that the Trump/Hegseth anti-trans policy “significantly limited the scope of the proceeding,“ such that it felt the need to add this information “[t]o accurately capture the totality” of the board’s findings regarding a trans service member.
