Alito confirming his likely retirement in 2027 seems like a desperate attempt by Republicans to motivate their base to show up on Election Day. It's not going to work. In fact, I'd argue it motivates Democrats to turn out even more than they already were.

New from the SLRI newsletter: Drop What You’re Doing And Bask In This State Supreme Court Justice’s Latest Broadside Against The U.S. Supreme Court open.substack.com/pub/slri/p/d...
"The Court overrides what Congress passed.
It overrides what the people chose. All to serve its own ends. What this Court has done to constitutional rights, democratic institutions, and the rule of law explains why Hawaii's Constitution takes no instruction from it," Eddins wrote. A Supreme Court
"that systematically dismantles democratic safeguards, steamrolls constitutional liberties, and tramples human dignity," he said, "does not chart the course for the Hawaii Constitution."

one of my strongest beliefs is that we're in our situation right now bc some of the most prominent talking heads (e.g. joe rogan, andrew schulz) are learning about politics in their 40s and 50s, instead of their teens and early 20s, and we have to go along for the ride as they learn basic things

The thing to understand is that district court judges have to follow the law and Supreme Court Justices get to just make up the law.

If the U.S. government is going to take the position that, once removed from the United States, folks can’t be brought back, then it sure seems to me that federal courts should be reflexively and categorically barring *all* removals until they’re 100 percent certain that the removals are lawful.

If you're protesting this weekend, know your rights when interacting with law enforcement, including immigration agents.
Black graphic with text:
"Know Your Protest Rights.
You don't need a permit to protest in response to breaking news and you don't need a permit to march in the streets or along sidewalks, as long as you're not obstructing traffic or access to buildings. When you are lawfully present in any public space, you have the right to photograph anything in plain view, including federal buildings and the police. If you believe your rights have been violated, when you can, write down everything you remember, get contact information for witnesses, and take photographs of any injuries. If you get stopped by the police, ask if you're free to go. If they say yes, calmly walk away.If you get arrested, you have a right to ask why. Otherwise, say you wish to remain silent and ask for a lawyer immediately. Don't sign, say or agree to anything without a lawyer present. If you get stopped by a member of the military or any law enforcement office at a protest, you have the right to remain silent or to tell them that you'll only answer questions in the presence of an attorney-no matter your citizenship or immigration status.”Know Your Rights. Trump is on shaky ground when it comes to the way he has empowered perhaps the most important figure in the new administration.

NEW: Twenty-one former federal judges, including multiple former appeals court judges, urge President Biden to clear the federal death row. They include David Tatel (D.C. Cir.) and Diane Wood (7th Cir.), both of whom left the bench earlier this year. www.documentcloud.org/documents/25...
December 11, 2024
President Joseph R. Biden, Jr.
The White House
1600 Pennsylvania Avenue, NW
Washington, DC 20500
Dear President Biden:
We are former federal judges who are deeply committed to the rule of law.
While we may have different views on various issues related to the death penalty, we are united in our view that it is appropriate and important for you to commute all federal death sentences to life in prison without parole. Based on our experience and understanding, the administration of the federal death penalty has been rife with fundamental problems, including race discrimination in trial and sentencing, intellectual disability of defendants, and appallingly poor legal representation. Accordingly, federal executions should not proceed. We urge you to use your constitutional commutation power.
We greatly appreciate your attention to this issue.

While we’re on the topic of clemency — Biden ran as opposed to death penalty in 2020, and while Trump is sure to set up a new execution spree like he did last time, Biden has the power to commute the sentences of people on the federal death row.

Much of the science used to convict Russell Maze of killing his baby is considered questionable. New evidence points so much toward innocence that the DA’s office called for his release. He still might spend the rest of his life in prison. By @pamelacolloff.bsky.social

He Was Convicted of Killing His Baby. The DA’s Office Says He’s Innocent, but That Might Not Be Enough.
When new scientific evidence casts doubt on convictions, the justice system has no easy path to freedom — even when it’s the prosecutors doing the asking.
