7 The Magistrate Judge noted at the hearing held on June 23, 2026, that it appears this specific America PAC
post on X is not in the summary judgment record. (Hearing Tr., Dkt. 64, at 64–68). Plaintiff’s counsel
believed the image was located in the record but stated “if it’s not, I would definitely want to supplement.”
(Id. at 65). The Magistrate Judge then asked Defense counsel whether she was “disputing that [the image of
this post] exists.” (Id. at 67). Defense counsel did not explicitly answer whether she was disputing it exists and
instead discussed the content of the post; the Magistrate Judge followed up by saying, “It sounds like, I mean,
from what you’re saying, you do have a lot of information about this particular post.” (Id. at 68). Additionally,
Defendants’ Reply in support of their Motion for Summary Judgment does not object to this image. Given
that Defendants did not object, the Court in its discretion will consider the image. See Eguia v. Tompkins, 756
