In today's birthright citizenship decision, the majority of the justices take the position that courts sometimes can't force the Executive to follow the law. That begs the question: if courts can't force the president to follow the law, who can?

NEW: The Trump admin asks the Fourth Circuit for an emergency stay of Judge Xinis's order to "facilitate" Kilmar Abrego Garcia's return, arguing that the court has no authority to demand it take any affirmative steps to secure his release. storage.courtlistener.com/recap/gov.us...
EMERGENCY MOTION FOR STAY PENDING APPEAL AND PETITION FOR WRIT OF MANDAMUS
Article II of the Constitution bestows on the President-and through him, the
Executive Branch-the exclusive power over foreign relations. The Supreme Court
reaffirmed that principle in this very case, unanimously rejecting the District Court's
unprecedented command that the Executive actually effectuate the return of Abrego Garcia from El Salvador—i.e., force a foreign sovereign to relinquish one of its own citizens. Under the guise of an amended order, however, the same District Court has set down the same unjustifiable path, all in service of a member of a foreign terrorist organization with no valid right to be in the United States in the first place. This
Court's immediate intervention is needed.
The federal courts do not have the authority to press-gang the President or his
agents into taking any particular act of diplomacy. Instead, in this context, the courts only have the authority to order the Executive to "facilitate" the return of an alien removed abroad. And as that term has long been understood and applied, that means

For the reasons discussed during today’s status conference, the Court finds that the Defendants have failed to comply with this Court’s Order at ECF No. 51. In advance of the conference, the Court had directed Defendants to file a supplemental declaration from an individual with personal knowledge, addressing the following: (1) the current physical location and custodial status of Abrego Garcia; (2) what steps, if any, Defendants have taken to facilitate Abrego Garcia’s immediate return to the United States; and (3) what additional steps Defendants will take, and when, to facilitate his return. ECF No. 51. Defendants made no meaningful effort to comply. Instead, they complained that the Order is “unreasonable and impracticable,” and involves “sensitive country-specific considerations wholly inappropriate for judicial review.” ECF No. 59 at 2.

NEW: Mass. federal judge Denise Casper transfers Rümeysa Öztürk's deportation case to VERMONT. She denies the govt's request to transfer to Louisiana, following the model set by NY federal judge Jesse Furman when he transferred Mahmoud Khalil's case to NJ. storage.courtlistener.com/recap/gov.us...
IV. Conclusion
For the reasons articulated below, the Court DENIES the government's motion to dismiss
this Petition and its alternative request to transfer this matter to the Western District of Louisiana.
The Court ALLOWS the alternative relief sought by Ozturk and transfers this matter "in the
interest of justice" pursuant 28 U.S.C. § 1631 to the U.S. District Court for the District of Vermont.
To ensure that Ozturk has an opportunity to have the Petition considered by the District of
Vermont, and to preserve the status quo, this Court's March 28, 2025 Order enjoining the government from removing her from the United States, D. 16, shall remain in effect unless and until the transferee court orders otherwise. See Khalil, 2025 WL 849803, at *14 (ordering same upon transfer).
So Ordered.
Denise J. Casper
United States District Judge

Footnotes:
§ For at least this reason, the Court rejects the government's argument that if it did not dismiss the Petition, it should instead transfer it to the Western District of Louisiana, where Ozturk was not detained at the time of the filing of the Petition.
* It will be for the District of Vermont to determine if it has jurisdiction over Ozturk's
Petition notwithstanding her later transfer to Louisiana after the filing of the Petition that is now transferred there. See Khalil v. Joyce, 2025 WL 972959, at *24-38 (taking transferred petition as filed in New Jersey at the time it had been filed in S.D.N. Y.).

WHOA. On March 15, a Cornell PhD student with UK and Gambian citizenship, here on a student visa, filed a lawsuit seeking to overturn Trump's EO aimed at foreign students accused of "antisemitism. Last night, the DOJ emailed asking him to come to ICE to be detained and put into removal proceedings.
Last night at 12:52 AM, the Department of Justice contacted the undersigned via email. Under the subject line “Momodou Taal et al v. Trump, 25-cv-335 (NDNY),” the government informed the undersigned for the first time that the government intended to serve Mr. Taal with a Notice to Appear (NTA), and that they intended to take Mr. Taal into the custody of Immigration and Customs Enforcement. Given that this information confirms the factual basis for Plaintiffs’ request for an emergency temporary restraining order, ECF No. 23, and the increased urgency with which the Court’s intervention is needed, we respectfully request the Court construe this letter as any procedurally appropriate vehicle to obtain the same. Plaintiffs’ counsel is immediately available to follow up with any submissions the Court deems appropriate in this extraordinary situation. Attached to this letter is an affidavit from Counsel Eric Lee (Exhibit 4), the government’s 12:52 AM email (Exhibit 5), and Plaintiffs’ counsel’s reply (Exhibit 6). The email reads: My colleagues and I represent the United States in this matter. The applications for admission of Messrs. Stone, Moss, and myself to the bar of the U.S. District Court for the Northern District of New York are pending, so we have not noticed our appearances yet. But we wanted to reach out to establish a line of communication, and relate some information concerning your client. U.S. Immigration and Customs Enforcement (ICE) has asked us to convey to you the following. ICE invites Mr. Taal and his counsel to appear in-person at the HSI Office in Syracuse at a mutually agreeable time for personal service of the NTA and for Mr. Taal to surrender to ICE custody. Accordingly, if you are interested in proposing such a date and time, we will promptly forward it to ICE for consideration
