Mit dem Erkenntnis des Verfassungsgerichtshof ist einer nicht binären Person Recht gegeben, denn ihr war vor niedrigerer Instanz eine Streichung des Geschlechteintrags noch verwehrt worden. 🎉 Welche Folgen das hat und was sich nun für nicht binäre Personen ändert, erfahrt ihr in diesem Post. ✨️

Die erfolgreiche Genderklage einer nicht binären Person richtet sich auf die Streichung des Geschlechtseintrags im Personenstandregister. Dies ist ein großer Schritt nach vorne für die rechtliche Anerkennung nicht binärer Menschen in Österreich.

Auf neue Pässe müssen wir aber noch ein bisschen länger warten:
Die klagende Person bis zur Austellung eines neuen Erkenntnisses durch das Landesverwaltungsgericht Wien und alle anderen auf einen neuen Erlass des Innenministers an die Standesämter.

Mit diesem Urteil setzt der Verfassungsgerichtshof folgender wichtige Zeichen:

1. er bricht den Widerstand des Innenministeriums
2. er erteilt dem Glauben, die Zweigeschlechterordnung sei Fundament der gesellschaftlichen Ordnung, eine Absage
3. er erkennt die Lebensrealität von trans und insbesondere nicht binären Personen und deren Schwierigkeiten an

Seitdem das Personenstandsgesetz 1983 die Möglichkeit schuf, den eigenen Geschlechtseintrag zu ändern klagt die queere Community gegen die Auslegung dieses Gesetzes durch das Innenministerium.
2006 hat der Verfassungsgerichtshof den Scheidungszwang aufgehoben.
2009 hat der Verfassungsgerichtshof den Operationszwan aufgehoben.
2018 folgten die rechtliche Anerkennung von intergeschlechtlichen Personen, sowie die zusätzlichen Geschlechtseinträge inter, divers, offen und die Möglichkeit der Streichung.
