“The daily atrocities in Gaza carry an appalling human toll and are being perpetrated by Israel in overt defiance of fundamental rules of international law and human rights,” states the letter, signed by barristers, solicitors and academics based in the Republic, Northern Ireland, England, Belgium and Australia.

Successive Irish governments “have delayed and prevaricated” on the Occupied Territories Bill when there are no “insurmountable legal obstacles” in either Irish, European or international law preventing the adoption of legislation prohibiting the import of goods and services produced in the unlawful Israeli settlements in the West Bank, it states.

Until October 2024, successive Irish governments blocked the Occupied Territories Bill, citing concerns that it would breach EU trade rules.
This was despite the Bill passing nearly all necessary stages in both houses of the Oireachtas, with both the Dail and the Seanad voting in favour.
However, recent legal opinions confirm that Ireland is entitled to ban trade with Israeli
settlements under EU law. While trade rules are generally uniform across all EU member states, exceptions can be made for reasons of public morality, public policy, public security, and the protection of human health and life.
The two newly published formal legal opinions from Professor Takis Tridimas and Professor Panos Koutrakos, leading experts in EU trade law, affirm the legal basis of the Bill and its compatibility with EU law. The legal experts criticised the previous Attorney General's advice, which blocked the Bill, as

In a newly published legal opinion, two leading experts on EU law have stated that Ireland is fully entitled to pass the Occupied Territories Bill, criticising the Attorney General's advice as "erroneous" and "at odds with settled EU case law"
The experts state that: "It is striking that the AG should have ignored the judgements in [two cases] where the European Court of Justice expressly held that Member States may deviate from EU law, including... on public policy grounds in order to protect fundamental rights...

Israel is the most depraved regime on earth. Lying day after day and starving an entire population to death. A few miles away, Israeli kids eat fast food. Many children can no longer even walk due to dizziness and weakness from famine. Supported by Western governments, it's unforgivable.
