Human Rights and Radical Political Philosophy Roberto Buonamano Free chapter | Unravelling human rights: questions of method doi.org/10.4337/9781... More information: www.e-elgar.com/shop/isbn/97...
Human Rights and Radical Political Philosophy engages in a critique of international human rights law through readings of influential European philosophers. Roberto Buonamano explores novel and valuable perspectives on the conceptualization of human rights and their relationship to the modern State.

Taking the radical political philosophies of Michel Foucault, Giorgio Agamben, Jacques Derrida, and Jean-Luc Nancy as a starting point, Buonamano interrogates the commonly received meanings of foundational concepts such as rights, democracy, freedom, and the State. Within the ambit of genealogy, human rights are examined through Foucault's analyses of governmentality and the subject of truth, and through Agamben’s political ontological theses. The book furthers this discussion by assessing Derrida’s deconstruction of the concepts of humanity, sovereignty, and democracy, as well as Nancy’s re-evaluation of the political in terms of non-subjective sovereignty and ‘being-in-common’.

Research Handbook on Privacy and Confidentiality in Media Law Edited by Normann Witzleb, Megan Richardson and Damian Clifford Free - read the Introduction: doi.org/10.4337/9781... Available in print through our website: www.e-elgar.com/shop/isbn/97...
This comprehensive Research Handbook explores how the media has shaped, and been shaped by, the law of privacy and confidentiality. Leading experts from a range of jurisdictions investigate how the law and regulation in this area has evolved in response to changing media forms, functions and practices.

The central theme that emerges from this collection is that privacy, confidentiality and data protection standards now exert stronger influence on media law than ever before. Analysing key topics such as physical and digital privacy, non-disclosure agreements and data protection claims against the media, the Research Handbook underscores the enduring importance of journalistic reporting and the foundational value of freedom of expression in democratic societies. At the same time, the contributors demonstrate that respect for confidentiality, privacy and data protection is also indispensable for human dignity, autonomy and the flourishing of modern information societies. This collection explores the continuing need for privacy law to adapt to emerging technologies and new social practices, such as the changing dynamics of media production and consumption.

Research Handbook on Legal Geography Edited by Alex Jeffrey and Sarah Klosterkamp Free - read the Introduction: doi.org/10.4337/9781... Available in print through our website: www.e-elgar.com/shop/isbn/97... @legalgeolsa.bsky.social
This comprehensive Research Handbook explores the concepts, methods and empirical work that shape the field of legal geography. Bringing together interdisciplinary scholars, it examines how legal norms and institutions shape, and are shaped by, the organization of economic and social life.

Contributors address the discipline’s foundational principles of property, territory and sovereignty while engaging with contemporary issues such as urban governance, environmental regulation and transnational legal regimes. Referencing global case studies, chapters illustrate how various infrastructures influence spatial justice and configure landscapes of inclusion and exclusion to highlight how legal categories and procedures are unevenly enacted across space. Advocating for a dialogue between legal and economic geography, contributors sketch the grounds for sustained shared projects whereby law and geography are approached as mutually constitutive.

The Law and Theory of Patents Toshiko Takenaka, Hunter Simpson Professor of Technology Law, @uwlaw.bsky.social Free chapter | Patent system history: doi.org/10.4337/9781... Available in print through our website: www.e-elgar.com/shop/isbn/97...
This definitive comparative treatise provides a clear framework for understanding both the theory and practice of patent law. Grounded in the relevant international treaties such as the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), the book identifies international obligations and draws out the common principles shared by patent systems across Europe and North America.

Beginning with a historical perspective, the book provides an analytical overview of patent law as a dynamic system shaped by digital transformation, and traces how the foundational doctrines of patent law have evolved and adapted to the realities of Industry 4.0, digital transformation, and AI innovation. In addition to delivering doctrinal analysis of the fundamentals of patent law, such as eligibility, novelty, inventive step, infringement, claim scope, remedies and defenses, the book also presents research questions inviting readers to examine how platform ecosystems, servitization, and AI tools challenge how these fundamentals are approached. It situates novel developments within the structure of traditional patent principles and concludes with forward-thinking research questions designed to stimulate future inquiries.

International Sale of Goods Law Djakhongir Saidov, Professor of Commercial Law, @kcllaw.bsky.social Free chapter | International trade: English law and the Vienna Sales Convention: doi.org/10.4337/9781... Available in print through our website: www.e-elgar.com/shop/isbn/97...
This book provides an analytical study of the law and practice of the international sale of goods through two leading international sales law regimes: English sales law and the UN Convention on Contracts for the International Sale of Goods. Djakhongir Saidov evaluates them side by side, interconnecting their experiences against a variety of trade sectors and contracts.

Saidov systematically examines global case law, revealing the richness of commercial and legal landscapes to provide a balanced reflection on the diversity of trade sectors. Across the chapters he assesses different types of sale contracts, including those used in the commodities trade, long-term sale contracts, contracts of sale of manufactured goods and sale contracts embedded in supply chains. The book concludes that no single sales law is equally well suited to all contracts, sectors and commercial contexts, unless specialist sub-sets within each sales law were to be developed for each sector.

This authoritative Research Handbook examines legal training and its impact on law and society. Leading experts adopt a kaleidoscope perspective to compare diverse country case studies, highlighting shifting patterns rather than a single model of ‘global’ legal education.

Contributors explore how legal education remains nationalised via local histories, politics and markets, despite borrowing models and language from modern, merit-based, or global approaches. Chapters assess the appearance of law schools as powerful sites where divisions of class, race, gender, empire and prestige are reproduced, contested and sometimes reimagined. The Research Handbook demonstrates how familiar patterns of hierarchies, inequalities and Western-centric ideals travel widely alongside diverse efforts in majority world contexts to resist, revisit and reimagine fairer institutions. Combining doctrinal analysis, institutional histories, archives, interviews and fieldwork, this Research Handbook advances research and promotes further study.

This thought-provoking book investigates the legal and practical difficulties faced by detainees attempting to challenge their detentions in non-international armed conflicts (NIACs), particularly those in which a State holds detainees outside its own territory.

Detention in Extraterritorial Non-International Armed Conflicts provides crucial insights into State practices on detention review boards, establishing the minimum legal criteria for an independent and impartial process. Chapters explore the treatment of NIACs under international humanitarian law and international human rights law, highlighting the limitations of both. Through conducting innovative research into the difference between judicial and administrative independence, the book proposes practical guidelines to assist detaining authorities in implementing their review obligations.

Even the most carefully designed legal rules, procedures, and institutions cannot function effectively without the appropriate engagement of the individuals who operate within them. Contributing to contemporary debates, this authoritative book examines the subjective dimension of the rule of law and the dispositions that can enhance it, illuminating its potential and limits for promoting a resilient rule-of-law culture.

Contributors explore the interplay between virtue and the rule of law from a historical and multicultural perspective, outlining how the rule of law is under strain in many countries, not only in those considered rogue or authoritarian. They propose that it is possible to connect the institutional and procedural dimension of the law with the skills and virtues of those involved in its practice. The book concludes by sketching a future in which a virtue-ethical approach can effectively support and enrich legal practice, inviting readers to reconsider the rule of law as a living practice sustained by virtues, judgment, and responsibility.

The Availability of Standard-Essential Patent-Based Injunctions: Interpreting FRAND Commitments Jingwen Liu Free chapter | Standard-essential patent: preserving private interest in a concerted effort: doi.org/10.4337/9781... Available in print from our website: www.e-elgar.com/shop/isbn/97...
In light of the building number of high profile cases relating to Fair, Reasonable and Non-discriminatory (FRAND) commitments, this authoritative book explores the fundamental question of whether, and when, a Standard-Essential Patent (SEP) holder’s injunction request will be justified.

Jingwen Liu explores key areas and concepts in FRAND cases, including the legal nature and consequences of a FRAND commitment, the transnational and procedural problems surrounding FRAND litigations and economic perspectives of standard setting and FRAND licensing activities. Liu proposes a three-step analytical framework to assess SEP-based injunctions, including a timely examination of the ‘willing licensor’ and ‘willing licensee’ tests. The book concludes that the only way to properly address injunction issues is through adopting an expansive interpretation of FRAND, which converts it from a one-off, rate-based requirement to an ongoing, conduct-based principle.

This illuminating book examines how people managed their creative and inventive works before the modern intellectual property (IP) system. Neil J. Wilkof explores how individuals treated intellectual creations in their respective times and across differing political, cultural, and religious backgrounds.

Written as an engaging narrative, and presenting a wide range of historical and geographical accounts, the book traces IP from the Biblical era to the Industrial Revolution and from Edinburgh to Baghdad. Each chapter explores a self-contained historical period, highlighting the diversity of people, locations, periods, and circumstances prior to the modern harmonisation of legal IP. The narrative illuminates the motivations for protecting creation and invention, underscoring notable attitudinal differences between then and now. Rather than seeking to uncover historical antecedents to the modern IP system, the book addresses intellectual historical creations and inventions on their own terms and within their own milieu.
