The language in this opinion reminds me of the Ninth Circuit death penalty cases when the Supreme Court got fed up playing whack-a-mole with seriatim lower court stays. The justices are absolutely fed up and the Eighth Circuit panel gets its teeth kicked in, politely.

Once again, competitors (and their media) draw the wrong causal arrows. The Brewers succeed by making *good baseball decisions* using market size as a smokescreen, not by selling off players for the sake of doing so. A salary cap is meaningless in these decisions. Glad nobody realizes this though!

An old argument rekindled at the ol’ law office today: is an engagement ring a conditional gift? If one of you breaks it off, does the ring legally have to be returned? Does it matter who breaks it off? Law professors love this problem for obvious reasons.

This makes me hopeful. This number is aspirational but nowhere near out of reach: a working professional could realistically cash out their 401k and buy off a public official. Owning a senator is more attainable for most Americans than home ownership.

The unbridled hostility of this opinion to the Missouri State Supreme Court is something to behold. Somehow these right wing judges have convinced themselves that Republicans are the victim in Missouri even though their rigging of the process is what caused the problems to begin with.

By being opposed a salary cap, the players are somehow opposed to higher minimum salaries. Just the stupidest, laziest framing. Pretty sure owners can raise the salaries anytime they want and will have to do so either way in any agreement.

If I’m the Missouri Supreme Court, the one thing I can clearly still do is make factual findings. And I find, if supported, that the Secretary of State proceeded in bad faith and deliberately obstructed state law, which finding is essentially final and the federal courts have to acknowledge it.
