Things got more insane just about as soon as I posted this last night. DHS is now arguing that we cannot even put the names of ICE officers in our lawsuit against those officers. Their position is that, if a defendant works for DHS, they cannot be named in a lawsuit. Never seen anything like it.
All this time, while Defendants have refused to identify Does 4 and 5 or respond to Leo’s discovery requests, the six-month statute of limitations on his FTCA claims has nearly expired. So, on October 6, Leo sought Defendants’ consent to file an amended complaint that (1) adds his FTCA claims against the United States and (2) adds the names of Does 1, 2, and 3. These minimal changes are shown in a redline attached to this filing.
Defendants, however, refused to consent to Leo’s amendments because there is not a protective order in place. One of Defendants’ positions with respect to the protective order is that the “full legal names” of all government employees “should be confidential.” (ECF 109, at 2). That position, apparently, means that Defendants even oppose Leo identifying specific officers in his lawsuit against those very officers based on their misconduct in carrying out their public duties. Because Defendants will not consent to Leo’s amendments, Leo has filed this motion for leave.Justice also requires granting Leo leave to name the Doe officers as defendants. Despite DHS’s remarkable position that all government employees’ names are confidential, parties routinely sue government employees by name. In fact, Rule 10(a) “requires a complaint to ‘include the names of all the parties.’” Doe v. Frank, 951 F.2d 320, 322 (11th Cir. 1992) (per curiam) (quoting Fed. R. Civ. P. 10(a)). “Lawsuits are public events.” Id. Rule 10(a) “protects the public’s legitimate interest in knowing all of the facts involved, including the identity of the parties.” Id. Only in an “exceptional case” can a party’s name be withheld from the public. Id. And that bar is even higher for public employees since their employment “diminishes their privacy interests” given “the corresponding public interest in knowing how public employees are performing their jobs.” Stern v. FBI, 737 F.2d 84, 92 (D.C. Cir. 1984);

One of the most heated discussions occurring on X at the moment is about the ethics of a GitHub project in which a person is running Saw-like “torture” and “pain” experiments on a series of locally hosted large language models, causing a series of effective altruists and people who believe LLMs are sentient to beg GitHub to delete the project on the grounds that the AI is suffering and that this glorified text adventure game is somehow cruel. The saga is an outgrowth of several recent viral papers and blog posts that have sparked a wildly tiresome conversation about AI consciousness and the idea of “model welfare,” which is essentially worrying about the “mental health” of AI bots and agents.

Rumors about “rigged elections" are now a fixture of U.S. elections, leading to diminished trust in election results & democracy (broadly). These rumors can sometimes be hard to debunk, esp. in their early stages. Our UW team has identified the 6 common ways that election integrity rumors mislead:
Infographic titled "Six Ways 'Rigged Election' Rumors Mislead." A two-column table pairs six labeled categories with descriptions. The first three categories are:

No Evidence: The rumor is entirely unsubstantiated. There's no evidence to support the rumor.

Fake/False Evidence: The rumor is based on fake or synthetic evidence (e.g. AI-generated content), manipulated evidence, or false witness testimony.

Misinterpreted Evidence: This rumor is based upon real evidence that has been misinterpreted or intentionally mischaracterized to create a false impression.

A black banner then introduces the final three categories: "Real Evidence, Real Voting Issue, False Narrative."

Exaggerated Impact: The rumor centers on a real issue with voting but falsely insinuates or exaggerates impact on election results.

Ignored Remedies: The rumor centers on a real issue with voting but ignores and/or obscures the remedies that would address this problem

False Blame: The rumor centers on a real issue with voting but either falsely attributes intent for an accidental issue or places blame on an innocent party.

Here in North Austin, where ICE agents appear to have shot an individual in his car. I spoke to two of the only witnesses.

Nedevia Bolaños and her husband, Carlos, own a business just off the intersection where the shooting happened. Shortly before 1 pm they says they heard what sounded like two gunshots. Carlos ran out first. A blue Toyota sedan and a black Escalade were stopped under the highway.Combined tweets, cutting tags and other such

He said he saw an olive-skinned man, seemingly in his 30s, leaning backwards against his seat. A masked agent was standing outside the car. The agent refused to answer questions. Within a few minutes as many as 10 other ICE agents arrived.

Carlos asked the victim if he was ok. "Yes," the man said in Spanish, but he looked exhausted. Carlos asked why they had shot him. "Because I didn't stop."Combined tweets, cutting tags and other such.

Bolaños ran up next. She said she continously asked the ICE agents about why they'd shot him and if they were going to render aid. They didn't answer her. It was an APD officer who later arrived and cut open the young mans shirt, revealing a deep hole between his shoulder blades. The ambulance arrived about 10 minutes after and carried him off. "I've never seen all this. Thank God I'm a citizen," Bolaños said in Spanish. "Or I'd be living like this. In a dream of terror."

OK. I mentioned this before, won't belabor it, but this paragraph is art. I would wager a not-inconsiderable sum that Herodotus, Pliny the Elder, Augustine, and Lon Chaney have never been cited in a single paragraph before. (And hopefully never will again.)
Plaintiff has sued Wizards for $10M because he believes he created and exclusively owns the
idea for a “wereshark” and that Wizards has infringed upon his creation. By way of relevant
background, lycanthropic monsters – werewolves and the like – have been found in folklore and
fiction since antiquity. Hundreds of years before the Common Era, Herodotus wrote of the Neuri, a
tribe northeast of Scythia that would reportedly transform into wolves for several days once a year.
Herodotus, The Histories, 4.105 (circa 440 BCE). Werewolves continued to appear in folklore from
antiquity through modern times, and across a wide range of cultures. See, e.g., Pausanias, Description of
Greece, 8.2 (circa 160-180 CE); Ovid, The Metamorphoses, I 219-239 (circa 8 CE); Pliny the Elder,
Natural History, VIII.34 (circa 77 CE); Augustine, The City of God, XVIII.17 (circa 426 CE); King
Canute, Ecclesiastical Ordinances, c. 26 (circa 1020 CE); Anonymous, The Tale of Igor’s Campaign (circa
late 1100s) (Slavic folklore); Marie de France, Bisclavret (circa 1200); Völsungasaga, ch. 8 (circa 1250
CE) (Nordic folklore). Bram Stoker depicted Dracula as a werewolf in Dracula’s Guest. Werewolves
1 Plaintiff Lap-Sun Chan named “Dungeons and Dragons Wizards of the Coast LLC” as the Defendant, but Dungeons
and Dragons is a game published and owned by Wizards of the Coast, LLC, not a distinct entity.
2 See Chan v. Ramdhaney, Case No. 1:22-cv-03708 (S.D.N.Y 2022) 3 See Eng v. Podolnick, No. 1:14-cv-04675 (S.D.N.Y 2014) (dismissed for failure to comply with order requiring Plaintiff to
“file an amended complaint not containing the stricken portions or any other racist, anti-Semitic, or insulting language”).came to the silver screen first in Werewolf of London (1935) and then Lon Chaney’s definitive
performance in The Wolf Man (1941), and have essentially never left it since. And animal
shapeshifting has not been limited to wolves. Greek mythology is replete with humans (or humanshaped gods) who transform into animals or monsters. In Tlingit folklore, Kóoshdaa are wereotters. Celtic mythology includes selkies (were-seals) and kelpies (shape-shifting water-horses that
live in lochs). DC Comics has featured numerous shark-human hybrids since its Silver Age,
including Guppy (a small-time criminal in Nightwing’s rogues’ gallery, first appearance in 2018),
King Shark (the son of a shark god and a human mother, first appearance in 1994), and Karshon (a
mutated shark, first appearance in Green Lantern 24, October 1963). Other examples abound.

BREAKING: Federal judge hearing the CASA challenge to Trump’s efforts to end birthright citizenship issues a second preliminary injunction in the case, barring application of Trump’s latest executive order to the class members previously covered in the CASA case.
dispelled any doubts about the meaning and scope of the Citizenship Clause of the Fourteenth
Amendment. Or so it seemed.
A month after Barbara came down, the President continued his efforts to abolish birthright
citizenship for many Americans. This time, the President issued Executive Order 14418,
"Continuing to Protect the Meaning and Value of American Citizenship" (*2026 Executive Order"), which "identifies, non-exhaustively, and prescribes action concerning certain categories of children of aliens who do not fall within the rule of birthright citizenship as announced by the
Supreme Court" in Barbara. Exec. Order No. 14418, 91 Fed. Reg. 51991, § 1 (Aug. 11, 2026).
Even a cursory review of the 2026 Executive Order's carveouts to birthright citizenship reveals
they bear little to no resemblance to the "narrow exceptions" to the rule of citizenship by birth recognized by the Supreme Court in Barbara, 146 S. Ct. at 2450, and United States v. Wong Kim Ark, 159 U.S. 649, 693 (1898). But the question before the Court today is not whether the purported
carveouts to birthright citizenship in the 2026 Executive Order are unconstitutional. The narrower question is whether the plaintiffs are entitled to preliminary injunctive relief because the 2026 Executive Order is likely unconstitutional as applied to the certified class. The answer to that
question is yes.
The 2026 Executive Order is almost certainly unconstitutional as applied to the certified
class for the simple reason that the Supreme Court in Barbara already decided that the children in the class are citizens at birth. This Court must, once again, preliminarily enjoin enforcement of the President's most recent attempt to strip the right to citizenship from them.For the reasons stated above and those stated in the memorandum opinion issued today, it
is this 2nd day of September, 2026 hereby ORDERED that
The plaintiffs' renewed motion for a preliminary injunction or temporary
restraining order, ECF 178, is GRANTED in part and DENIED in part as follows:
a. The motion for a preliminary injunction is GRANTED; and
b. The motion for a temporary restraining order is DENIED as moot;

4.
Administration, and their officers, agents, servants, employees, and attorneys, and any other persons who are in active concert or participation with them are ENJOINED from enforcing or applying the 2026 Executive Order against the class representatives and the members of the certified class and from taking any other action to interfere with, deny, or fail to recognize the citizenship of any member of the certified class until further order of this Court;
The defendants may develop and issue public guidance under Section 3(b) of the
2026 Executive Order;
The security requirement is waived;
