Another great post from Prof. Fishkin dismantling the Chancellor’s statements re the 9/11 symposium. Yet again the Chancellor avoids answering a simple question: was anything anyone said or did in our conference endorsing antisemitism or terrorism? The only answer is “no.” But he won’t admit it.

Deeply disappointed (again) by UCLA’s Chancellor, but never more proud of my colleagues. More than 50 signed a letter demanding a retraction. Chancellor Frenk’s double speak would make Donald Trump proud. He _still_ refuses to say what part of our conference was antisemitic. Because it wasn’t.

I didn't say they were the same, I said they were two sides of the same coin--can't have one without the other. Also, you don't seem to want to address what the Chancellor actually said—you have done that twice now. I'm not sure why that is, but I'm guessing it's not productive to keep asking you.

As for whether his statements violate the neutrality rule, just read the statement itself. No one could seriously think this is neutral on the issues we discussed at the conference, and that's certainly not how any of the newspapers understood it: newsroom.ucla.edu/chancellor-j...

It is a very clear violation of UCLA's policy, which says the “chancellor … should not make public statements on societal, public and political matters, unless those matters directly affect the university’s ability to support a research and educational environment where free expression thrives.”

Have you read Frenk's statement? It does FAR more than that. It strongly suggests our conference was antisemitic and pro-terrorism--based on nothing whatsoever. It also suggests we did something wrong in inviting a defense attorney (who is a DOD employee). dailybruin.com/2026/09/12/j...

This ignores the elephant in the room—that he’s the Chancellor. Under University policies adopted at UCLA (and most famously also adopted at U Chicago), the institutional leadership has to remain neutral on matters of public concern to preserve academic freedom for students, faculty, and staff.

Cecilia directed immigrant rights giving among philanthropy for over a decade. She ran Obama's immigration policy/political strategy for a full eight years, and she was the lead on Biden's domestic policy transition team. There is far more wrong with the Noem v Perdomo shadow docket order than one can say in a single post. But one particularly hypocritical and disingenuous piece is Justice Kavanaugh's citations Biden v Tx (twice), and US v Tx. The Supreme Court DECLINED TO STAY the lower court orders in both cases.

There are almost no cases about this provision, but the few imm court cases suggest the IJ would treat the Secretary's determination as almost immune from review. That makes it very very hard to challenge in immigration court, but strengthens the constitutional args against the statute itself.

It has never been applied to cases involving people already admitted to the United States, so applying it here would involve a fairly radical change to the constitutional law in this area.

Yes exactly. Why haven’t I heard anyone say this in the press yet? You can’t remove people before they have a removal order. Also can’t remove them to Cuba without Cuba’s consent. This is not complicated.

But there are cases that construe that particular regulation to say that it codifies a probable cause requirement. People cannot be arrested by immigration agents on less than probable cause.

Actually courts read "reason to believe" to mean probable cause. Sorry I can't give you a cite rn... It's implicit in the constitutional rule from Brignoni Ponce, which says "detention or search must be based on consent or probable cause," except for brief inquiries during car stops (like Terry).

Check out my piece @justsecurity.org about yesterday's DOJ memo threatening to prosecute state officials for following sanctuary policies. TLDR: the Trump admin can't do that!! It's not a crime to follow sanctuary policies, and more generally not a crime to simply ignore ICE's demands for help.

This lawsuit is about the June 2024 asylum restriction that Biden put into effect, which was justified in part by the existence of alternate legal pathways like CBP One. Eliminating that pathway now makes this regulation less defensible. Trump will aim to replace it, exact method still unclear.
