8. Il résulte de l’instruction qui s’est poursuivie à l’audience devant le juge des référés du Conseil d’Etat, que M. B..., qui s’il est vrai, n’avait pas produit les éléments ou pièces aux services de la préfecture du Val d’Oise relatifs au maintien de ses liens familiaux, a justifié, par les pièces produites en appel relatives à ses envois d’argent et par les échanges enregistrés dans son téléphone, avoir maintenu, en dépit de son éloignement depuis plus de dix ans du Cameroun, des liens suffisamment étroits avec les membres de sa famille et, en particulier, sa mère jusqu’à son décès, ce qui n’est plus désormais contesté par l’administration. M. B... a également fait état des obligations morales et culturelles qui s’imposent à lui et qu’il tient à assumer, en ce qui concerne l’organisation et la conduite des funérailles de sa mère dans son pays, compte tenu de sa position d’aîné au sein d’une fratrie également composée d’une sœur et d’un frère. Il justifie ainsi d’une situation exceptionnelle en lien avec un motif humanitaire au sens de la pratique administrative rappelée par la circulaire mentionnée au point 5.

9. Il résulte également de l’instruction que l’intéressé poursuit son engagement au sein de la branche française de l’ONG qu’il a créée et qu’il préside. Il indique que les risques qu’il fasse l’objet à nouveau d’une persécution par les autorités de son pays en cas de retour au Cameroun, ne peuvent être totalement exclus. Toutefois, il fait également valoir qu’en vertu des usages en Afrique et de l’adage selon lequel le deuil éteint les querelles, le motif du déplacement au Cameroun et la délivrance du sauf-conduit par lequel il entend manifester qu’il entend revendiquer la protection de la France en sa qualité de réfugié, devraient actuellement suffire à le protéger pendant la durée limitée de son voyage.

11. Le ministre de l’intérieur ne fait état d’aucun autre motif lié en particulier à l’ordre public ou à la sécurité nationale faisant obstacle à la délivrance du sauf-conduit à M. B....

Il résulte de tout ce qui précède que le refus de délivrance du sauf-conduit sollicité pour le motif à caractère humanitaire de la participation aux funérailles d’un proche a dans les circonstances particulières de l’espèce, pour effet de porter une atteinte au droit de M. B..., en sa qualité de réfugié, de mener une vie privée et familiale normale garantie par les stipulations de l’article 8 de la convention européenne de sauvegarde des droits de l’homme et des libertés fondamentales. Il s’ensuit que M. B... est alors fondé à se prévaloir d’une atteinte grave et manifestement illégale à une liberté fondamentale. Eu égard à la proximité des funérailles de la mère de l’intéressé et des formalités qu’il reste à accomplir pour organiser le déplacement prévu dès le 20 juin pour des funérailles devant débuter le 26 juin 2026, la condition d’urgence doit être regardée comme satisfaite.

13. Il y a lieu, par suite, d’enjoindre au ministre de l’intérieur qu’il soit procédé à très bref délai par l’autorité compétente au réexamen de la demande de délivrance du sauf-conduit sollicité en particulier à la lumière des éléments apportés par l’instruction qu’il a conduite.

14. Il y a lieu, par suite, sans qu’il soit besoin de se prononcer sur sa régularité, d’annuler l’ordonnance du juge des référés du tribunal administratif de Cergy-Pontoise et d’enjoindre au ministre de l’intérieur qu’il soit procédé par l’autorité compétente à très bref délai au réexamen de la demande de M. B... tendant à la délivrance du sauf-conduit sollicité.
