Trump v. Slaughter rests on a deeply flawed theory of democracy and demonstrably erroneous history. Nor is there a workable limit for the bright line rule articulated in the case. See Trump v. Cook. Trump v. Slaughter should be read as narrowly as possible and ultimately overruled.

Although it is about the ‘regular’ policy process, I think punctuated equilibrium is still a viable explanatory framework. I just don’t know whether it has been applied at the system level. There is always path dependency and lock-in as useful explanatory concepts that provide reference points.

One possibility is to resurrect and apply aggressively the public utility model. Current applications are not consistent with how it was originally conceived and first applied. Legislative compromises almost always weaken such efforts. Bill Novak (UMICH!) is the best thinker on this model.

Even the 1970 Clean Air Act passed at the height of the environmental movement did not include such an aggressive enforcement mechanism. Reliance on the states and 3rd parties, so-called citizen attorneys general, was politically necessary. It couldn’t be achieved now without broad business buy in.

In both cases, public commentary on the law by law ‘experts’ and outcomes of the political process that seem to violate the common political morality, political scientists can offer revealing insight supported by their research. I am surprised more political scientists don’t do that.

Holder v. Humanitarian Law Project was one of the supreme court’s worst decisions in its history, probably just on the tier below its most notorious infamies (Dred Scott, korematsu, trump v us, etc.); it was a gift-wrapped recipe for exactly the sort of repression we’re now seeing.
