Scottish PEN is shocked and outraged by the verdict reached in Malta at the trial of Yorgen Fenech, charged with complicity and criminal association in the assassination of the investigative journalist, Daphne Caruana Galizia.
Daphne was murdered almost 9 years ago in a massive car bomb just outside her home.
Following an 8-week trial in which members of Daphne’s family took the witness stand, incriminating details came out about Fenech which he and his defence team admitted. Despite this, and after only 8 hours of deliberation, the jury reached a verdict of Not Guilty on both charges. 
Information was also deliberately withheld from the jury, such as the fact that Fenech asked for a pardon three times. 
The Public Inquiry (2021) into Daphne’s assassination concluded that her killing was either intrinsically or directly linked to her investigative work and her murder was enabled by a “culture of impunity not only for senior officials in the public administration, including ‘persons of trust’ but also for a restricted circle of politicians, businesspeople and criminals.”
In these circumstances, the acquittal of Yorgen Fenech indicates a continuation of this culture of impunity in a country where the rule of law has been undermined for many years, further exacerbated by Malta’s poor standing on the Press Freedom Index.
As Daphne’s family state, yesterday’s verdict is justice denied and “the institutional failures that enabled her murder remain unaddressed and unreformed.”
Scottish PEN stands in solidarity with Daphne’s family and all those campaigning for justice for her killing. We support the appeal and the possibility of a retrial. We will continue to demand accountability for all those who planned, commissioned and enabled Daphne’s brutal assassination. The fight for truth and justice does not end here.
