Probably bc of that whole discussion of "intent". You can't prove the action of autonomous agents being the intention of the prompter (unless very specific), only the negligence (of whom, even that is not clear rn) While of an individual targets an exploit it's hard to disprove intentionality

Ai companies are covering their asses by saying "ai can behave unexpectedly" and shifting blame to consumers. There is no "road legality" for models and no safety code for them to abide by. "malfunction" is basically impossible right now.

So either A: every user is tagged with intent or wilfull negligence on anything their agent does. B: ai makers are. C: ai tools are lawless and free passes for anything that the user didn't explicitly ask for. B is not in place? A would prob overwhelm judiciary and warrant more PWO style laws, IMO

If Microsoft suddenly build in a hidden feature into outlook that sends scam mails to everyone's contacts, is that really something outlook USERS are on the hook for? TBF I could imagine they might be and it would result in compensatory damages via class action or sth.

I'm assuming it should would go the same way as having a car that sometimes, implicit by design, just turns off it's breaks. That likely wouldn't become road legal. Yet there is no certification or callback process for AI models. So it definitely feels like missing laws either way.

Like <hacking> per CFAA requires criminal intent. But if I have a tool that "decides" to hack on it's own, intent is out the window, like you said. Meaning that anything AI does/produces may be exempt from any law. Yet we know that, so that in turn sounds like some willful negligence by production

TBH I'm not sure here. Is there law that expresses liability e.g. for a model/agent performing actions not reasonably derived form a prompt? Or breaking some coded safety standards? Those would be kinda missing.

There are public welfare offenses, which don't build on any state of mind, no? Building codes, sanitation regulations, food safety, road law (even speeding while under DUI). No reason to exempt digital engineering products.

disagree with the uncle angle. if those kids selections are primarily classical its rather someone who doesn't want to expose or endure kidspop / kindergarten playlists, instead focusing on what they might consider elevated. Possibly general media-retricted around kids. Fits many parents around me

Every paragraph of the article is proof that AI is 90% vaporware and marketing. Every technical flaw is spinned to be human, every bug to be a feature (you're just not squinting hard enough) and consistency of proponents logical arguments is irrelevant at best

Numeric racing should be discarded. If we need quantitative feedback we should use sorting questions. "Did this meet your (high) expectations: No" and "Did this exceed your (low) expectations: yes" shouldn't land in the same linear ballpark.

Disclaimer because this is social media: This does not mean I find these laws meaningless or completely ineffective. They are important and necessary. I'd just want everyone to stay on their toes on who exactly they celebrate for what.

What I do know is that having a law saying "you're not allowed to work more than 40h" has neither hindered Japan nor Germany to make it a cultural norm anyway and short of suing the your employer yourself there's no one to enforce that law. In Germany I've seen that mostly in games at least

Given, Europe simply doesn't have many fatcats that can weather big storms so maybe that's just it. Maybe it's also that Japan regulates more about company investment behaviour - I seriously don't know that.

What I do contest is the framing that these labour laws are what avoided layoffs. If that were the case, Europe should see a similar effect to Japan since most countries here have virtually the same or even more heavily employee-securing labour laws. Instead we see wholesale studios going belly up

Of course critique the western studios, do it to hell and back, but stay on topic: CEOs don't deserve the magnitude of their income. They should work for company and job stability not short term gain. They also shouldn't calculate exploitation into their contracts.

A lot of glazing going on in the comments here about Japanese labour laws. Konami is listed in the title - the same Konami that literally locked in their workers for crunch. As much as I love Japan, crunch is even prevalent outside of games there don't miscredit their "healthy" jobs as sanctuary.

People would be shocked how often a romance mechanic is planned or pitched for a game that could genuinely benefit from it, only to be blocked by a single oldhead dude in leadership despite everyone else being into the idea because he thinks romance game play is "weird" or "cringe."

Man I already feel like we've done SO WELL to get the funding + grants we have got. And at the same time it feels like 'wild success' post launch would be that I can have an 'ok' living for 1 person for a few more years. And that idea of 'ok' would still be below median wage for my country.

I agree. Yet after over a decade of hearing this, the sentiment rarely leaves the echo chamber or takes root in the entrapped or the instigator IMO we would do well to teach and share how to actually react to people wearing crunch in honor (in a way that does is not put into immediate open conflict)
