Right. So in addition to using privilege selectively as sword and shield, DOJ‘s not-a-denial response further augments the defendant-exonerees’ calls for discovery—now we need to understand the circumstances in which Mecklenburg called the felony counts the “strongest” charges.

Worth noting that DOJ‘s response selectively invoking assertedly-privileged communications does not really refute refute Mecklenburg’s allegations. She could well have recommended misdemeanor charges while (or before/after) noting that the felony charges are the “strongest.”

This is a good article. Until now, I thought the only reason for Maryland to do this by voter-approved constitutional amendment was the cowardice of Democratic leaders looking for cover from voters, because Dems could redraw the districts through ordinary legislation.

Pirro lied not only in the press conference a month ago but also, as @emptywheel.bsky.social points out, in this week’s motion to dismiss the indictment. But Pirro’s lies and Burgum’s lies conflict in ways that improve the chances that Hearn will be able to further expose all of them.

As you point out, these other cases have shown that Trump U.S. Attorneys capitulate rather than defend their conduct. Not just on the terms of the dismissal but also on the entitlement of the defendant to collect attorney’s fees.

That’s my thinking here. An objection to a “without prejudice” dismissal is normally an uphill climb, in part because of the now-beleaguered presumption of regularity. Pirro’s motion and your post provide enough evidence to rebut that presumption.

I really think Hearn (or another defendant in the same boat) should ask the judge to withhold leave of court under Rule 48(a) for the “without prejudice” dismissal. Demand that the motion to obtain GJ records be resolved first or get a “with prejudice” dismissal.

But I think there are like six other people who are in the same boat. I’d think one of them would want to keep fighting. Also, there could be financial incentives, I think, through fee-shifting statutes if the GJ proceedings were as much of a shitshow as I suspect.

I‘d expect that “means“ are not much of a constraint here, either because people would gladly support a crowd-funding effort or because the lawyers are working pro bono. The bigger constraint might be just “I’m sick of this shit.” Which, I understand.

Not a criminal lawyer, but Rule 48(a) allows a defendant to object to a “without prejudice” dismissal. I would ask the court to withhold leave of court for the dismissal until the motion to obtain the GJ materials is resolved.
