Our proposed legislative framework suggests restricting their use to (1) serious crimes, subject to (2) exhaustion requirements, along with (3) a multi-step process subject to judicial oversight at every step of the way.

Now that SCOTUS has ruled that "geofence warrants" are 4th Amendment searches, Congress and state legislatures need to enact legislation to guide how and when such warrants should be issued. Here's a guide my Clinic wrote tackling just that question. tlpc.colorado.edu/tlpc-publish...

Current "digital sovereignty" discourse holds that states can do as they please with internet infrastructure on their territory. I argue for extending transit principles to the Internet's infrastructure, with the strongest protections for core networks.

Transit is what keeps straits open to navigation even where the bordering states claim sovereignty in their waters. Every major international infrastructure is protected by transit rights, save for one: the Internet.

Vivek Krishnamurthy @vivekdotca.bsky.social · 01/06/2026
My article recovers transit as a structural principle of international law. Transit in this sense refers to the right of foreign persons, goods, and conveyances to cross sovereign territory when convenient or necessary to an international voyage.

In his Article, @vivekdotca.bsky.social surveys four centuries of transit law, which requires states to permit passage across their territory. He distills transit law’s principles and makes the case for extending them to digital infrastructure and the internet.

You're right that many of the decrees enacted under the relevant article of the French legislation deal with both imports to and exports from Russia. But the press release doesn't offer us much to go on.

I couldn’t say based on the current publicly available information and my quick read of the relevant French laws. But I was struck by how the provisions to which the press release alludes form the legal basis for parts of France’s export control and sanctions regime against Russia.

This is especially so because sovereign rights at sea are layered in three dimensions. By analogy, we could consider layering sovereign rights in cyberspace. Specifically, different sovereigns might exercise different kinds of sovereign rights over different layers of the internet.

Vivek Krishnamurthy @vivekdotca.bsky.social · 26/08/2024
A state's sovereign rights over the seas off their shores diminish as one move further out to sea, and they are subject to the rights of other states (and their nationals) to engage in peaceful uses of those seas. My article argues that this is a good way to think of the nature of state power online
000
Vivek Krishnamurthy @vivekdotca.bsky.social · 26/08/2024
Instead, I argue that the notion of "sovereign rights" we find in the law of the sea offers a better way of conceptualizing the powers of states in the online sphere.

Vivek Krishnamurthy @vivekdotca.bsky.social · 26/08/2024
My article challenges the now-widespread belief in legal academia and government circles that traditional, Westphalian notions of territorial sovereignty can and should be applied to cyberspace.
