The 9th Circuit has administratively stayed Judge Bastian's order, meaning Roger Rogoff is out (again) as US Atty of WD Wash. So as things stand, he is fired again.
The court has received the government's emergency motion for stay pending
appeal. Dkt. No. 9. The request for an administrative stay is GRANTED. The
court's administrative stay "is only intended to preserve the status quo until the
substantive motion for a stay pending appeal can be considered on the merits, and
does not constitute in any way a decision as to the merits" of the appeal. See Doe
#I v. Trump, 944 F.3d 1222, 1223 (9th Cir. 2019).

Without conceding anything, Roger Rogoff—the court-appointed & Trump-fired & judge-reinstated US Atty in Seattle—agrees to remain out of office till the govt's appeal is decided. (9th Cir had granted a temporary stay yesterday.) storage.courtlistener.com/recap/gov.us...
Rogoff does not oppose Defendants' request for a stay pending appeal, as set
forth in docket entry 9.1 of this case. In filing this statement, he does not concede that Defendants are likely to succeed on the merits of this appeal or satisfy any of the other requirements for a stay. Rogoff reserves all rights, claims, and
arguments.

Hearn's case presents "exceptional" circumstances. He "faces the unique possibility that the govt will revive this case—one that it has already announced to be meritless—based on political pressure brought by the President of the United States on his subordinate officers."
While all defendants deal with
some degree of uncertainty regarding the odds of re-prosecution after a case has been
dismissed, Mr. Hearn faces the unique possibility that the government will revive this case - one that it has already announced to be meritless - based on political pressure

back where it was at the beginning-a financially insolvent facility and a

Unanimous, bipartisan court says that “blanket” diplomatic assurances are inconsistent with the statutory scheme and it doubts they are workable in practice. 5/6
We note that neither the public record nor the record in

this case discloses what countries, if any, have provided the State

Department with the diplomatic assurances contemplated by the

Guidance and what countries, if any, have declined to do so. We

also note that, although it does not affect our analysis, we have

some difficulty seeing how a receiving country can credibly provide

blanket assurances that all removed noncitizens will not be

persecuted or tortured there unless it intends to provide them

with some sort of affirmative protection against rogue agents and

non-state actors, who can be persecutors within the meaning

of $ 1231 (b) (3), see Paye v. Garland, 109 F.4th 1, 11-12 (Ist Cir.

2024), and torturers within the meaning of the FARRA/CAT,

for the Trump administration, for me, to get involved, and to take on long term, and to carry it, or to raise money to carry it, I think that the Trump administration should certainly have recognition. Because frankly, if we don't do that, it's going to close, it will end up being ripped down.!

Judge Cooper issues order requiring 30-days notice before any "demolition" of the main Kennedy Center bldg. Also seems to grant plaintiffs discovery into the Kennedy Center demolition posterboards Trump was photographed looking at.
MINUTE ORDER: Plaintiff's [84] Motion for an Emergency Hearing is hereby DENIED. By September 23, 2026, Defendants shall a file a detailed status report, supported by a sworn declaration from a knowledgeable representative of the Kennedy Center, on the "temporary closure" and emergency repairs described in Defendants' [86] Response and Mr. Floca's [86-1] supporting declaration. Further, the parties are reminded of Defendants' representation to the Court in the companion case D.C. Preservation League that they will "inform Plaintiffs and the Court if there is any change in the Board's plans that would constitute a reversal of the Center's position that the building will not be demolished and that no new structure will be constructed." Joint Meet & Confer Report (Aug. 28, 2026), Case No. 26-cv-981 (CRC), ECF No. 62 at 2. To avoid any confusion on that score given more recent events, the Court hereby ORDERS Defendants to provide such notice in writing to Plaintiffs in both cases more than 30 days before the implementation of any changes to the scope of the project plans presented to the Court in D.C.
Preservation League, including but not limited to any "demolition" of the Center's main building.
Finally, Plaintiff may seek discovery regarding the subject of their [85] Notice of Supplemental Authority to the extent permitted by the Federal Rules and the Court's scheduling order. SO ORDERED. Signed by Judge Christopher R. Cooper on 09/17/2026.

Rep. Beatty's attys ask for immediate order barring demolition of the Kennedy Center, saying it would be a "monumental breach of fiduciary duty, clear violation of the ... statute" creating the Center, and potentially a federal crime. storage.courtlistener.com/recap/gov.us...
In response to questions from reporters he stated that if he is not recognized on the building, it will close and be ripped down.4 Separately, images on social media depict him reading a placard on Air Force One that reads "Kennedy Center DEMOLISHED." This on its own—is deeply concerning. It would represent a monumental breach of fiduciary duty, a clear violation of the organic statute, and also potentially a violation of criminal law. See 18 U.S.C § 1361. And Defendants have also stated that
unless Trump's name goes on the Kennedy Center's façade, no renovations will be undertaken. To that end, at a minimum, Plaintiff requests the Court enter an order making clear that either the wholesale demolition of the building or demolition that would make public
access impossible would violate the Court's existing order.

Trump explicitly vows that reconstruction & renovation of the Kennedy Center won't begin unless & until he gets his name on it.
The Board of The Kennedy Center today agreed, almost unanimously, to close the Building for Safety reasons, and so that it can begin the process of Reconstruction.
The closing will take place immediately, however, the Renovation and Reconstruction, which is a very large and complex job, cannot begin until such time as the D.C. Circuit rules on the Board's approved name. If the ruling is a negative one, which it should not be, and is not overturned by the U.S. Supreme Court, the Reconstruction and the Renovation of The Kennedy Center will not take place. The attorneys from the DOJ will ask for an expedited appeal. In the meantime, 17 Million Dollars, raised by President Trump, has been put into The Kennedy Center account to keep it afloat. Thank you for your attention to this matter! President DONALD J.

Here's the threat from the Kennedy Center's Trump-appointed board. Without "appropriate recognition" of Trump on the facade it's "unlikely" there will be any financial rescue. Board then lists 10 options for slapping his name on the building. storage.courtlistener.com/recap/gov.us...
WHEREAS, the Center is seeking to appropriately recognize and acknowledge President Trump for his well timed proffer of fiscal rescue. The Board understands that without such appropriate recognition it is unlikely that President Trump will provide the fundamental oversight of the renovation of the main building and lead the fiscal rescue of the Center. The Board seeks to provide multiple options so that President Trump can be legally and appropriately recognized and acknowledged on the facade of the Kennedy Center so that he agrees to carry the burden of managing the renovation and provides the Center with a much required financial rescue.
IT IS HEREBY RESOLVED that the Center will undertake all legal means to effectuate one or more of the following public recognitions or acknowledgements to the President:
TO BE PLACED ON THE EXTERIOR MARBLE BENEATH THE NAME OF THE CENTER, ONE OF THE FOLLOWING as voted upon by the Board:
• Option 1:

Judge LaPlante (GWBush), in the Barbara v Trump birthright citizenship case in New Hampshire, is "skeptical" that he can order relief against Trump's tweaked, post-SCOTUS-ruling executive order in the case's current procedural posture. (I assume he wants an amended complaint or new case filing.)
ENDORSED ORDER re 22 4 Motion for Preliminary Injunction. Text of Order: Counsel should not anticipate the scheduling or preliminary relief requested on an expedited basis. (See doc. no. 92.)
The court is skeptical of the lawfulness and procedural propriety of using this action -- via the motion to clarify doc. no.80 and the filings that have followed as the vehicle to challenge a

new executive order that addresses different categories of persons and imposes distinct prohibitions not previously adjudicated. The court is currently reviewing the law in that regard. No briefing is requested. Normal FRCP deadlines apply pending further orders from the court. So Ordered by

SG Sauer explains the status of the govt's SCOTUS applications here:
On Thursday, September 3, 2026, the federal government filed in the above-captioned case an application for a stay of an order issued on August 27, 2026, by the United States District Court for the District of Massachusetts. Labeled as a 14-day temporary restraining order, but effectively functioning as a preliminary injunction, that order barred the implementation or enforcement of several sections of a Postal Service rule regarding the mailing of federal-election ballots.
On Friday, September 4, 2026, the district court formally issued a preliminary injunction
that was substantively identical to its August 27 order, which it purported to dissolve. The United States appealed that injunction the same evening, and it filed a motion the next day in the United States Court of Appeals for the First Circuit to stay the new order pending appeal. Earlier today, in an abundance of caution, the United States filed in this Court a new application for a stay of the renewed preliminary injunction. In light of those developments, and to simplify proceedings, the United States withdraws its September 3 stay application in the above-captioned case.
