Not defending tariffs (at all), but the story is a bit more complicated: “The British Parliament passed the Tea Act in May 1773 to help the company. This gave the East India Company a tax break on their tea, which made it cheaper than tea that was being smuggled into the colonies from other places.”

Just to be clear, the executive branch has no constitutional authority to refuse a court appearance on the ground of a unilateral determination that the law favors the president’s position. If the courts don’t push back, the rule of law, always precarious, never perfectly realized, is dead.
