Even having a Gender Recognition Certificate doesn’t magically resolve it. And what happens when somebody says: “She never told me.” and the trans defendant says: “Yes I fucking did”?

They KNOW why some trans people fiercely protect this information. They KNOW how profoundly private it is, how disclosure can be dangerous, yet they nevertheless contemplate NON-DISCLOSURE becoming part of the basis of a rape prosecution.

Then it produced 'guidance' under which a trans person’s FAILURE TO DISCLOSE that they are trans can potentially be treated as deception relevant to whether consent was valid. Not lying or falsely answering a direct question.

I’ve now read the CPS consultation response on “deception as to sex”. And I am fucking furious. The CPS actually asked whether its approach properly balanced the rights of trans people to live fully in their acquired gender against the rights of complainants.

I can only hope that people now start to take notice that they urgently need to look at the registered protocols on PROSPERO. There are at least half a dozen that need detailed scrutiny, including 2 that I've seen so far which involve Emily Simonoff.

That data can now be completely fragmented in the statistics and the only way to find out is to get a detailed view on all the secondary diagnosis of GIDS patients. And so in the latest report, the only number available is 104 related to the entire period 2016-2023 (on p.13). Impossible to challenge

patients can now be hidden away in Depressive disorder or under the high-level header of Mental health or even one of the comorbidities. And so the NHS can keep going about its merry way to ignore the actual impact they are having on patients with gender incongruence.

#UK #NHS #NCISH Twice in the past year have I tried to warn everyone about the consequences of certain decisions taken by the NHS. The first warning was when I highlighted that no patient had received a primary diagnosis of gender dysphoria/incongruence since July 2024. Secondary diagnosis however

I’m not just angry about today as well - this didn’t start in April last year. It’s years of politicians who should have done more just ‘keeping quiet’. Years of journalists, and others in the Westminster bubble not doing enough to call out colleagues slipping down the rabbit hole.

Yes there are lots of brilliant trans people and allies fighting. But actually, as a collective society we have no need to do this. There is no serious economic or security context pushing us into this like other political decisions - it’s just pure cruelty and discrimination.

Our guidance recognises that providing only separate-sex services can have a particular impact on trans people. A combination of single-sex and mixed-sex or individual facilities can be a proportionate way of meeting different needs.
There may be circumstances where a service legitimately needs to establish someone's sex. But the code explains that it's unlikely to be practical or appropriate to inquire about sex where those facilities are incidental to the primary service.
We've had public toilets separated by sex for decades without someone verifying who is entitled to enter. The code doesn't change that.
Uncertainty about their rights has caused real alarm for many trans people. But some of the commentary surrounding the code has worsened that distress, by alleging that it erodes those rights or requires routine sex checks. Those claims do not accurately describe the guidance.

If at first you don’t succeed, try, try again. A maxim that has been embraced by campaigners for men to be able to intrude into female spaces and for children experiencing gender distress to be pushed down a risky medical pathway, all under the misleading banner of “trans rights”. These campaigners have lost some important battles. Their strategy of bullying female opponents out of their jobs and public life ran into problems when the courts made clear that this was unlawful discrimination. Then the Supreme Court clarified that men are never women for the purpose of using female-only facilities and services.

Meanwhile the medical consensus is finally shifting to an understanding that children experiencing transitory gender distress, often a product of other issues, should be able to access exploratory therapy rather than puberty-blocking drugs.

Now gender campaigners have opened a new front, pushing for legislation to ban so-called “conversion practices”. This innocuous-sounding but dangerous Trojan horse is designed to override legal protections for single-sex spaces and to threaten parents, teachers and healthcare professionals acting in children’s best interests. Worst of all, it was adopted in Labour’s 2024 manifesto, a quid pro quo for the party dropping self-ID.

There is a long and terrible history of same-sex-attracted people being subjected to conversion practices such as electroshock therapy and corrective rape. These practices are thankfully rare, and importantly already criminal.

Mary-Ann Stephenson, chair of the Equality and Human Rights Commission (EHRC), said criticism of its updated code of practice had made the “real alarm” felt by trans people worse by wrongly suggesting they had lost protections or would face sex checks.

Stephenson said women had also been affected by not having access to single-sex spaces. She said: “Women who believe that their right to privacy, dignity or safety have not been properly protected deserve to have those concerns taken seriously too.”

Last week the Liberal Democrats passed a conference motion branding the code discriminatory and “unworkable”.

At Labour’s conference Joanne Thomas, the general secretary of the Usdaw union and chairwoman of Labour Unions, said the law and the EHRC code would hurt trans and nonbinary people and argued that rights had been rolled back.

Stephenson said the code did not create new law or abolish protections for transgender people.

She said: “Recognising women’s need for access to single-sex services doesn’t require us to dismiss the rights of trans people. And recognising the vulnerability of trans people doesn’t require us to dismiss women’s concerns.”

The EHRC’s code of practice came into force in August, 16 months after the Supreme Court ruled that sex in relation to the Equality Act must be defined biologically. This means single-sex lavatories, changing rooms, hospital wards and refuges must be used based on a person’s birth sex, not the gender with which they identify.

PS there are also state-level bans in federal states like the US and Australia. None of these countries have reported any problems. Bans in Taiwan, Queensland & Victoria (Australia), The Netherlands, New Zealand, Ecuador and Malta make conversion practices actual criminal offences.
