I mean, for a big enough benefit, I can see abandoning morals like “don’t help racist authoritarians complete a takeover of the world”. But it’d have to be a BIG benefit. “Computer make a meme for me because I don’t have the skills or sense of humor to create stuff on my own” is not sufficient.

My writing has value for the purpose of training And content creators should be able to control that market, as well as preventing some people from being able to do that, just as they can sell the right to reproduce.

If I post a treatise on the legality of copies of hard drives cloned by police departments, you can’t copy it and claim you wrote it. You CAN copy it to your computer to read it, if I published publicly. That kind of specialized post has value to AI trainers. And they should compete in THAT market.

They aren’t selling at all, as far as I know. They’re exchanging access to Twitter for exclusive control over the right to train on that user data. Regardless, access to training data is clearly valuable to them. It’s something AI companies compete for, and compete to pay for. It has market value.

Again, we treat different usage differently RIGHT NOW. Copying for reading isn’t prohibited (generally), but you can’t scrape a free website and present it as your work. Those are different usages. Machine access to judge search rank is not the same as machine access to train.

Why would it stop fair use? AI training access IS a market. That’s just a fact. Companies buy, sell, and protect access from competitors. Making it an explicit thing won’t prevent non-commercial usage in that vein. It’s merely accepting the reality that training is one way content is valuable.

The fact that the usage is part of the analysis should be evident by the fact that you’re pointing to “fair use”. Which implies unfair use. Which the law gets to define. The market an AI scraper harms is the market for the right to train on data. Which we know they’re already paying for right now.

That was poorly worded, but you CAN go to a website and read it. That process, by necessity, creates a copy on your computer. But you generally CAN’T copy it and redistribute. Both involve copies made. But the purpose of each is different. Training data IS a market. The author should control it.

I mean, it already covers uses. Making a copy to read while online and keep the tab open is one use. Making a copy to redistribute is not, based on fair use analysis. You’re trying to say there is no market for most words, but what you’re failing to account for is that training data IS a market.

And I think we should. Because if I put up a website for people to read, but I don’t want it trained on, that should be my right. It’s my words. If I keep my stuff offline, I have the right to train my own AI on my content. If someone else wants to do that, they can pay me what it’s worth.

If copyright includes “right to make copies of for AI training”, then social media sites can sell or hoard. But every private website is protected and can set their own rates, presumably per training run (so it’s an ongoing benefit). And we can make that the rule if we want.
