The law (HB 433) was mostly known for the provision that prevents local governments from requiring employers to adopt certain heat safety protections for workers. But it also goes after wage standards and predictive scheduling requirements, too.

The state agency, of course, is understaffed for the significant workload they've been given under Florida's SB 256 (another anti-union law passed in 2023) and SB 1296. Its budget has nearly doubled since 2022. caringclassrevolt.substack.com/p/floridas-u...

The new law only apples to petitions for elections that were filed after July 1. Since PERC typically takes a couple of months to actually conduct an election, we won't see that be applied just yet. But this month, unusually, showed little activity on the election front at all.

McKenna Schueler @shecarrieson.bsky.social · 01/09/2026
Under SB 1296, at least 50% of a proposed or existing bargaining unit must participate in a union election in order for the results to even count. Even if 49% of workers vote and all vote in favor of forming/recertifying their union. Public safety unions are exempted from this.

McKenna Schueler @shecarrieson.bsky.social · 01/09/2026
While at least a couple dozen representation and recertification elections are generally conducted by PERC each month, July 1 marked the first effective date of a new law (SB 1296) that changed how union elections are conducted in FL's public sector.

McKenna Schueler @shecarrieson.bsky.social · 01/09/2026
Unclear why, but the state agency that enforces labor law in Florida's public sector (Public Employees Relations Commission) conducted only 1 union election last month. Activity in general was super slow, not sure if this is related to a focus on rule-making around SB 1296.

Voluntary recognition is a less common way to form a union [these days], esp in the South where weak labor law has empowered employers to be more combative towards unions. FL lawmakers notably passed a law (SB 1296) this year banning voluntary recognition in the public sector.
