Make no mistake: this is indirect evidence the US has been exerting enormous pressure not only on the Court, its officials, and individual States Parties, but also on the ICC’s governing organ as such. The ASP strategy of ‘dialogue with States not party’ (appeasing the bully) has predictably failed.

Rubio is obviously wrong. But this is the first time the ASP is mentioned as a reason. Presumably it’s inaction to “constrain” the Court. It’s a golden opportunity for the ASP to react in the strongest terms, including an emergency Bureau and ASP meeting. Rebut Rubio. Act now.

The ASP Bureau decided that the 25th ASP session will be held in The Hague rather than in New York — the only sensible decision. This will allow delegates from all States Parties and NGO representatives to participate, and candidates standing in judicial elections to be present.
