This is unfortunately true, but we still have the recourse of protesting. They fear it. I can tell you firsthand that law enforcement is not there to stop a protest. They are Americans, too. Most of us still believe in the Constitution. We must exercise our freedom of speech or we will lose it.

With enough pressure from the people, We can do anything. People should be protesting at home, as well as on the Mall. Boycotts and waves of unsubscribers are also effective at motivating power. Waves of phone calls to Representatives coupled with protests at local offices are very effective.

A motion to vacate the chair is a parliamentary procedure used in the U.S. House of Representatives to force a vote of no confidence in the sitting Speaker and remove them from office.

How It Works

* Constitutional Basis: Article I, Section 2 of the U.S. Constitution gives the House the power to choose its Speaker, and under Jefferson’s Manual (the foundation for House rules), the body retains the power to remove a Speaker at its will.
* Privileged Status: Under House Rule IX, if a member introduces a resolution declaring the office of the Speaker vacant as a "privileged" resolution, the House must schedule it for floor consideration within two legislative days.
* Threshold to File: Depending on the standing House rules of a given Congress, the threshold to introduce the motion can vary. In the 118th Congress, as part of concessions made to secure the speakership, any single member of the House (majority or minority party) was allowed to introduce the motion.
* Voting Threshold: Once called up, the House can vote on procedural motions first—such as a "motion to table" (which kills the attempt). If those fail, the House votes directly on the resolution. Passing the motion requires a simple majority of those present and voting.

Historical Significance
While used as a threat throughout House history (notably against Speaker Joseph Cannon in 1910 and John Boehner in 2015), it has only resulted in the formal removal of a Speaker once in U.S. history:
* Kevin McCarthy (October 2023): Representative Matt Gaetz filed a motion to vacate, leading to a 216–210 vote that successfully removed Kevin McCarthy as Speaker—the first time a Speaker was ousted through this mechanism.
* Mike Johnson (May 2024): Representative Marjorie Taylor Greene brought a motion to vacate against Speaker Mike Johnson, but the House voted overwhelmingly (359–43) to table (kill) the motion.
What Happens After
If a motion to vacate passes, the speakership immediately becomes vacant. An interim Speaker pro tempore—selected from a confidential list previously provided by the ousted Speaker—takes the chair temporarily to preside solely over the election of a new permanent Speaker. Legislative business effectively halts until a new Speaker achieves a full majority vote on the House floor.
