250 years ago today—July 2, 1776—the Second Continental Congress voted for independence. It adopted the Lee Resolution, which said "these United Colonies are, and of right ought to be, free and independent States, that they are absolved from all allegiance to the British Crown" #America250

Important passage from Gorsuch’s concurrence in Trump v. Slaughter. Could this be foreshadowing the end of administrative agencies and rulemaking as we know it? Are there 4 more votes for this position? Is it reasonable to expect a modern Congress to write much more specific laws?

Slaughter is an earthquake: SCOTUS has overturned a 90-year-old precedent that facilitated much of modern governance by granting many agencies meaningful independence from the president. Now SCOTUS crushes that independence ... for seemingly every agency except the Federal Reserve.

Supreme Court punts on birthright citizenship, saying the "issue is not before us." However, significantly, Court says "Universal injunctions likely exceed the equitable authority that Congress has granted to federal courts." Therefore, the "applications for partial stays... are granted."

The Court grants the Govern. ment's applications for a partial stay of the injunctions entered below but only to the extent that the injunctions are broader than necessary to provide complete relief to each plaintiff with standing to sue.

Excited to present this paper with Tara Trask at APSA TLC #polisky
In-class games engage students in active learning through the application of theoretical concepts, sparking class discussion, and creating interaction between instructors and students. While students often know a great deal about the presidency, many have little knowledge of the executive branch beyond the Office of the President. The bureaucracy is more abstract and unfamiliar to students, in terms of its breadth, responsibilities, and power. To increase knowledge of bureaucratic organizations, as well as their importance and functions, students complete a March Madness-style tournament bracket of executive departments, agencies, and bureaus. Students must navigate the tricky venture of seeding, evaluating, and comparing agencies, always mindful of a potential upset. The completion of individual and collective brackets spurs classroom discussion on the purpose, roles, and variety of bureaucratic agencies, including the influence of executive agencies on our everyday lives.

Given repeated questions about Secret Service leadership, dating back more than a decade, is it time for Congress to amend 6 USC §113 to make the Secret Service Director position subject to Senate confirmation? Currently, the Director is appointed by the president and serves at their pleasure.

With California's votes now certified, this appears to be the final popular vote count. The margin of 1.47 percentage points is the smallest since the 2000 election. Kamala Harris received over 75 million votes in this election.

Makes me sad re-reading this amazing letter from ex-Watergate Special Prosecutor Archibald Cox sent to high school seniors in 1994 after they asked him “What should Americans learn from Watergate?” 20 years later in ‘94. His answer is remarkable—unfortunately things didn’t work out so well in 2024.

As Democrats conduct their post-mortem of the 2024 election, one eye needs to be focused on long-term strategy. The electoral map for Democrats is likely going to become much tougher in 2032 and beyond, as blue states are forecast to continue losing House seats and thus Electoral College votes
