ICYMI HISTORIC: For the first time in the state’s history, Virginia now allows misdemeanor or low-level felony convictions to be sealed! 2.5 million people in VA have a criminal record. These records have devastating consequences well after convictions and time served. #VALeg
Text: The record sealing law passed by the General Assembly in 2021 and then substantially amended in 2025 will take effect after a long, difficult wait. The newly enacted clean slate law allows a person with a misdemeanor or low-level felony conviction to have their record sealed from public view. Some of this record sealing will happen automatically.

In a concurring opinion today, Justice Gorsuch specifically mentions the governor's recent veto of a @justicefwdva.bsky.social / @salimforva.bsky.social bill to ban 4th Amendment plea waivers. Gorsuch suggests 4A waivers may be unconstitutional, an argument VA's public defenders have made for years.

“There are some progressives who are hardcore about cycling or pedestrians getting involved with cars,” said McEachin. “And that same group I find — and obviously this is a generality — is very concerned about surveillance and cameras in the city: Where are the cameras, and what are they capturing? Does the information go to (U.S. Immigration and Customs Enforcement) or somewhere else?

“But I want to say as a prosecutor that we could not do our job on the crash team … as well as we can without all of the surveillance cameras in the city because they capture license plates, they capture cars going here and there,” McEachin said.

According to Flock and the Richmond Police Chief, we are “powerful entities” using “coordinated attacks” to take down their mass surveillance … with 1/10th of the budget RPD has spent on cameras alone and 1/60,000th the money of Flock. ROFL 🤣 www.richmonder.org/rpd-has-spen...
In Staunton’s case, an unsolicited email from Flock’s CEO to its chief of police helped to turn the tide against the tech by baselessly casting residents’ objections to the technology as a “coordinated attack” by “activist groups who want to defund the police, weaken public safety, and normalize lawlessness.”  

Edwards echoed this framing, saying that “there [are] a lot of powerful entities that want to see this technology go away.” 
When asked to clarify, he alluded to “certain lobbyists that go to the General Assembly trying to tear this down,” but did not identify any critics by name. 

Flock, for its part, has powerful entities behind it as it pushes to expand in Virginia and across the country. … Flock touted its value at $7.5 billion. By contrast, Justice Forward Virginia, which has emerged as a key opponent of Flock’s lobbyists at the General Assembly, reported revenues of just $126,200 on its most recent filing with the IRS.
