Under the current law, investor-owned utility companies are financially incentivized to join a regional transmission organization. This unfair practice has passed costs onto consumers.

Today, my House Bill 2755 - Ending Excess Utility Profits - passed the House Energy Committee with strong bipartisan support. HB 2755 would mandate regional transmission organization participation and eliminate unneeded incentives.

To remediate this issue, data centers may seek certification to be a public convenience, which would make them a public utility. If data centers become a public utility, they could preempt local municipal zoning ordinances and reduce communities’ control over land-use decisions.

Chris Pielli @reppielli.com · 29/09/2026
Since 2020, when data centers started to be constructed, Pennsylvania’s energy costs have risen by over 70%. With estimates of up to 130 active data centers and an additional 55 data centers proposed, planned, or under construction, this problem will only get worse without proper regulation.
