Colorado responds to the DOJ motion to stay by apologizing to Judge Jackson for the "waste" of time, and complains the govt. has missed deadlines & withheld information: "These endless delays need to stop. Defendants should be promptly complying with the unchallenged portions of this Court’s order."
Plaintiff apologizes that this Court needs to waste its time on a motion that clearly ought
to have been resolved between the parties. When Defendants decided to forgo any further
briefing or reconsideration this afternoon (after repeatedly switching positions), they demanded a
position on their motion in less than two hours.
Plaintiff agrees—and has been clear with Defendants from the outset—that Defendants’
objections with respect to EOP should be resolved in an orderly manner.1
 Plaintiff has repeatedly
assured Defendants that it will not attempt to enforce any discovery obligations with respect to
EOP until there is a final resolution of this issue. That should have been the end of the matter,
and there was no reason to waste Court resources on a stay motion. Plaintiff does not make this request lightly. Defendants have repeatedly missed discovery
deadlines, provided incomplete responses, and withheld information without basis. These delays
have made completing discovery by the original deadline impossible. Plaintiff is still waiting for
complete responses to discovery served in early May. With respect to the portions of the
discovery order that this Court entered which Defendants are not challenging, Defendants have
not supplemented any responses or produced any additional documents, nor have they even been
willing to provide a date certain by which they will do so. These endless delays need to stop.
Defendants should be promptly complying with the unchallenged portions of this Court’s order

Stroud was denied funds to travel to the 1928 Olympic trials, almost certainly due to racism. So he walked, ran and hitchhiked from Colorado to Boston. He arrived with six hours to spare before his race started, but he collapsed from exhaustion on the sixth lap.
