While the law is often seen as something that lags behind new technologies, the reality is that technological development and laws shape each other in an ongoing dance. Silicon Valley businesses are influenced by existing laws, by how their lawyers interpret those laws, and by how those laws are or aren’t enforced. When laws that protect the public are enforced against tech businesses, then that sends a signal to similar businesses that they should minimize their harms and fit within the four corners of those laws. If such laws aren’t enforced, though, then that works as a green light for tech businesses to move fast and break things. That green light is a kind of subsidy, one that gives tech-based businesses a competitive edge over the industries they’re trying to disrupt (which do have to comply with existing laws). These “green light subsidies” can prop up technologies and business models that might have little to recommend them on a level legal playing field.

Sen. Angela Alsobrooks was wrapping up her holiday break this January when she noticed a message on her phone. It was a voicemail from Coinbase Chief Executive Brian Armstrong, and it was about three-minutes long.

The Maryland Democrat was a key negotiator over a landmark bill meant to usher digital assets into wider use. The two had been talking for months. When conversations with Alsobrooks and other lawmakers grew tense, the CEO could speak in a tone that some people working on the bill felt was inappropriate when talking to U.S. senators.A spokeswoman for Alsobrooks said she doesn’t comment on private conversations, but has had positive and productive conversations with Armstrong and other digital asset and banking leaders. “Senator Alsobrooks’ goal remains regulating this billion-dollar emerging technology,” the spokeswoman said.

I want to leave you with a word of caution before we start looking at these tech business models in detail. It is very easy to fall into the trap of accepting industry hype at face value, and then criticizing that hype rather than reality – as professor of science, technology, and society Lee Vinsel puts it, “it’s as if [criti-hypers] take press releases from startups and cover them with hellscapes.” But criticizing hype rather than reality can unwittingly amplify that hype and distract us from technology’s real but more mundane harms. That doesn’t mean that we shouldn’t be proactive and forward-looking: we absolutely should think about the downsides of realistic trajectories of technological development and use. But the word “realistic” is important here.

Criti-hype is a product of techno-solutionism because it uncritically assumes that technology will eventually do exactly what its boosters say it will, and then criticizes that. It fudges over present-day harms associated with the developing technology, and discounts the possibility that the technology is simply not capable of living up to the hype – not just that it’s just “early days,” but that the technology will never be able to deliver. Sometimes, the limitations of a particular technology can be hard to figure out in the moment, but sometimes they’re actually pretty clear if you care to look.

If you had told me in 2025 that we'd get to this point in 2026 without passing the Clarity Act, I never would have believed that such good fortune was possible. But today, it failed to get past a cloture vote in the Senate, and so the fundamental pillars of the securities laws remain intact.

Previous general purpose technologies, such as the steam engine, electrification and information technology, raised workers’ productivity by providing them with better tools. AI could go further by augmenting the production of knowledge itself. If, at some point, AI systems can improve their own capabilities and “create” technology and ideas, the macroeconomic consequences could be profoundly different from past innovations. A key constraint on long-run growth, namely the rate at which humans can generate new ideas, could be lifted.

crypto still has a longstanding Democrat Senate champion in New York’s Kirsten Gillibrand, who has co-sponsored several crypto bills with Cynthia Lummis over the years. Gillibrand is also known for campaigning on women’s rights issues, and yet her crypto bills have all studiously ignored the privacy dangers that blockchain-backed payments pose for victims of stalking and intimate partner violence (an issue we discussed back in Chapter 3).
