Statement from the Delaware Democrats PRIDE Caucus on the
Supreme Court Ruling on Trans Kids in Sports
The PRIDE Caucus condemns the Supreme Court's rulings in West Virginia v. B.P.J. and Little v.
Hecox, which allow states to ban transgender children from playing sports with their peers.
Both the American Academy of Pediatrics and the American Medical Association affirm that
sports are critical to a child’s development, fostering teamwork, friendship, and community. Yet,
as Justice Sotomayor noted in her dissent, the Court's majority ignored scientific evidence. They
failed to acknowledge that trans girls on puberty blockers do not maintain athletic advantages,
basing their ruling on bias rather than research.
These bans, currently active in 25 states, harm more than just transgender athletes. They have
already led to targeted harassment of cisgender girls who do not fit rigid gender stereotypes.
The invasive medical and physical surveillance required to enforce these laws is far more
damaging to children than competing against a transgender classmate.
Delaware has successfully blocked statewide bans so far, but barriers remain. Interscholastic
sports are governed by the Delaware Interscholastic Athletic Association (DIAA), and the
complete lack of publicly recorded transgender student-athletes in our state highlights how
difficult the approval process already is. Because the DIAA relies on Title IX, this ruling leaves
our students vulnerable by stripping away federal protections.
Delaware prides itself on being a safe, affirming state for LGBTQ+ youth. To live up to that
promise, the PRIDE Caucus urges the Delaware legislature to take immediate action and pass
legislation that permanently protects transgender student-athletes.
