Broad concept of personal data and future of EU data protection law  Nadezhda Purtova  Tilburg Institute for Law, Technology, and Society (TILT), Tilburg University, Tilburg, The Netherlands  ABSTRACT  Article 29 Working Party guidelines and the case law of the CJEU facilitate a plausible argument that in the near future everything will be or will contain personal data, leading to the application of data protection to everything: technology is rapidly moving towards perfect identifiability of information; datafication and advances in data analytics make everything (contain) information; and in increasingly ‘smart’ environments any information is likely to relate to a person in purpose or effect. At present, the broad notion of personal data is not problematic and even welcome. This will change in future. When the hyperconnected onlife world of data-driven agency arrives, the intensive compliance regime of the General Data Protection Regulation (GDPR) will become ‘the law of everything’, well-meant but impossible to maintain. By then we should abandon the distinction between personal and non-personal data, embrace the principle that all data processing should trigger protection, and understand how this protection can be scalable.

Many left-leaning politicians see free trade differently. Sen. Bernie Sanders opposed NAFTA, TPP, and trade normalization with China. They and the unions might he wrong. But at least those unions are being consistent regarding what they see as their interests regardless of who is in power.

"Disappeared" rightly means that the state has without due process abducted a person, that the person's whereabouts are not known, and it is not known whether the person's alive or dead since the govt doesn't acknowledge them. Misusing it for detentions one (rightly) disagrees with is demeaning.

I recall how German diplomats rolling their eyes (in 2018) when Trump brought up Germany's energy dependence on Russia became fodder for late night comedy TV. Trump was "fact-checked" by media back in 2018. Media hyper-partisanship is harmful regardless of who's in power.

Guess which US president said this.
The President said that for five years he has been urging the State Department to put the facts of life before the Europeans concerning reduction of our forces. Considering the European resources, and improvements in their economies, there is no reason that they cannot take on these burdens. Our forces were put there on a stop-gap emergency basis. The Europeans now attempt to consider this deployment as a permanent and definite commitment. We are carrying practically the whole weight of the strategic deterrent force, also conducting space activities, and atomic programs. We paid for most of the infrastructure, and maintain large air and naval forces as well as six divisions. He thinks the Europeans are close to “making a sucker out of Uncle Sam”; so long as they could prove a need for emergency help, that was one thing. But that time has passed.

I was at a shitty crustpunk bar once getting an after-work beer. One of those shitholes where the bartenders clearly hate you. So the bartender and I were ignoring one another when someone sits next to me and he immediately says, "no. get out."

And the dude next to me says, "hey i'm not doing anything, i'm a paying customer." and the bartender reaches under the counter for a bat or something and says, "out. now." and the dude leaves, kind of yelling. And he was dressed in a punk uniform, I noticed

Anyway, I asked what that was about and the bartender was like, "you didn't see his vest but it was all nazi shit. Iron crosses and stuff. You get to recognize them."

And i was like, ohok and he continues.

"you have to nip it in the bud immediately. These guys come in and it's always a nice, polite one. And you serve them because you don't want to cause a scene. And then they become a regular and after awhile they bring a friend. And that dude is cool too.

And then THEY bring friends and the friends bring friends and they stop being cool and then you realize, oh shit, this is a Nazi bar now. And it's too late because they're entrenched and if you try to kick them out, they cause a PROBLEM. So you have to shut them down.

And i was like, 'oh damn.' and he said "yeah, you have to ignore their reasonable arguments because their end goal is to be terrible, awful people."

And then he went back to ignoring me. But I haven't forgotten that at all.

**High-level Trump sources tell me the White House is now uncertain if they can get the Russians and Ukrainians to stop fighting because this episode with @ZelenskyyUa raised questions about whether he can move forward toward a peace deal. It also raises questions about whether US will pause aid to Ukraine. But Trump is NOT seeking regime change in Ukraine. No discussions about who in Ukraine might be a better leader than Zelenskyy.

Ukrainian officials have reached out this afternoon to senior White House officials desperate to get the deal back on track. But that will not happen today, I'm told. Trump is unwilling to talk to Zelenskyy further today.

When Rubio and Waltz went into the Roosevelt Room to ask Zelenskyy to leave, Rubio made it clear that any further engagements today would be counterproductive. Waltz told Zelenskyy he had made a tremendous mistake, and it was a grave disservice to Ukraine and to Americans, both.

No phone calls between Trump and Putin have been scheduled. But multiple European officials have called top Trump officials since Zelenskyy left asking how the minerals deal can be salvaged.

Trump fully intended to sign the minerals deal today. Two official binders were prepared -- Treasury Secretary Scott Bessent and his Ukrainian counterpart and the two presidents were going to sit at a conference table in the East Room and then trumpet their success at podiums.

But there were suspicions before Zelenskyy arrived today that it might fall apart. Because the Trump admin had been pushing for weeks for a minerals deal signing at the ministerial level, and Ukraine had refused. Zelenskyy wanted security guarantees.

US officials thought negotiations would be much harder with **Putin** so today have been been in disbelief that it has been Zelenskyy who has been more difficult, making maximalist demands, sources told me.

Against Big Tech's Attack on Digital Sovereignties

We the undersigned wish to express our deep concern regarding the ongoing attacks by Big Tech companies and their allies on Brazil's digital sovereignty. Brazil's dispute with Elon Musk is only the latest instance in a wider effort to restrict the ability of sovereign nations to define a digital developmental agenda free from the control of US-based megacorporations.

At the end of August, the Brazilian Supreme Court banned X from Brazilian cyberspace for failing to comply with court rulings demanding the suspension of accounts who instigated far-right extremists to take part in riots and occupy the Legislative, Judiciary and Governmental palaces on 8 January 2023. Subsequently, President Lula da Silva made clear the intention of the Brazilian government to pursue digital independence: lessening the countries' reliance of foreign entities for data, Al capabilities and digital infrastructure and promoting the development of local tech ecosystems. Pursuant to these objectives, the Brazilian state also intends to force Big Tech companies to pay fair taxes, comply with local laws and be held to account for the social externalities of their business models, which often promote violence and inequality.

These efforts have been met with attacks from X's owner and the far-right leaders complaining about democracy and free speech. But precisely because the digital space lacks international and democratically decided regulatory agreements, large tech companies operate as rulers, governing what shall be moderated and what is promoted in their platforms.

What's more, X and other companies have started organising themselves and their allies inside and outside the country to undermine initiatives aiming at Brazil's technological autonomy. Calling a woman an "illegitimate wife" (referring to the void status of the 2nd marriage of a woman who didn't divorce her 1st husband) doesn't violate constitutional rights under any sane reading of the Indian Constitution. The Supreme Court recognizes no limits to "the right to life" u/ Art. 21.
Under Article 21 of the Constitution of India, every person has a fundamental right to lead a dignified life. Calling a woman an 'illegitimate wife' or 'faithful mistress' will amount to a violation of the fundamental rights of that woman under Article 21 of the Constitution of India. Describing a woman by using these words is against the ethos and ideals of our Constitution. No one can use such adjectives while referring to a woman who is a party to a void marriage. Unfortunately, we find that such objectionable language is used in a judgment of the Full Bench of a High Court. The use of such words is misogynistic. The law laid by the Full Bench of the Bombay High Court is obviously not correct,' the Court observed.

You reference the new policy now allowing hate speech. I don't see where it does. Would you say that a Muslim saying that "homosexuality is a sin as per the Qur'an" is engaging in hate speech? Or that women calling for the exclusion of trans-women from women's sports would be violating the ICCPR?
People sometimes use sex- or gender-exclusive language when discussing access to spaces often limited by sex or gender, such as access to bathrooms, specific schools, specific military, law enforcement or teaching roles, and health or support groups. Other times, they call for exclusion or use insulting language in the context of discussing political or religious topics, such as when discussing transgender rights, immigration or homosexuality. Finally, sometimes people curse at a gender in the context of a romantic break-up. Our policies are designed to allow room for these types of speech.

SAME BUT DIFFERENT — Some of America’s best-known business leaders spent their holidays sucking up to President-elect Donald Trump. Netflix’s Ted Sarandos had dinner at Mar-a-Lago. An Amazon documentary is set to chronicle Melania Trump’s move into the White House. Mark Zuckerberg named Trump supporter Dana White to Meta’s board.

Their willingness to kiss the ring isn’t just about currying personal favor with the incoming president. After President Joe Biden ushered in a new era for aggressive anti-monopoly enforcement and pressed to curb the power of big business, CEOs are hoping the Trump administration might be a lot more friendly to consolidation, allowing powerful companies to merge without much oversight.

But Trump’s actions thus far have suggested he’s at least somewhat pro-aggressive antitrust enforcement. In a December flurry of Truth Social posts, he nominated Andrew Ferguson, a current commissioner of the Federal Trade Commission to replace Lina Khan as chair, antitrust attorney Mark Meador to be the third Republican FTC commissioner and Gail Slater to lead the Justice Department’s Antitrust Division.

The three are all conservatives but they represent a wing of the Trump Republican party that bucks conventional GOP thinking: They’ve criticized Big Tech not just for censoring conservative speech but also for being too big and too powerful — not so different from the left’s critique. Still, it’s an open question whether they’ll act on those concerns, especially when several major tech leaders are teed up for administration positions.

“This is a very powerful statement that Trump wants to take on Big Tech,” wrote Matt Stoller of Trump’s pick of Slater in a post on X. Stoller, who runs an anti-monopoly podcast and is a fellow at the American Economic Liberties Project, added in his newsletter, “while it won’t be like Joe Biden’s, it seems [Trump] is going to continue some significant parts of the anti-monopoly revival.“

It'd be interesting to know what's changed in EU regulation since you penned this in 2017 about the dangers to free speech from regulation by European countries, including from data protection laws.
Why should anyone else care? In the analog era, after all, a fair response in the United States to speech regulation across the pond (or anywhere else) might have been: that’s the way they do it in Europe. They have different experiences, giving some support (if very limited) to rules that U.S. courts would never permit—such as those against Holocaust denial or the glorification of terrorism.
But online space is different. All of the major companies operate at scale, and there is significant risk that troubling content regulations in Europe will seep into global corporate practices with an impact on the uses of social media and search worldwide. The possibility of global delinking of search results may be the most obvious form of content threat, but all of the rules and proposals noted above may slowly move to undermine freedom of expression. For instance, once a company invests the considerable funding required to develop sophisticated content filters for European markets, the barriers to applying them in American contexts are likely to come down.
To be clear, global attacks on online freedom of expression are severe. Illiberal governments around the world are imposing liability on individuals for posts and tweets and blogs that merely criticize public authorities or allegedly spread false information. That kind of regulation, a popular tool of repressive states, creates direct forms of censorship and individual harm. By contrast, European states have traditionally presented a protective environment for freedom of expression, with some—Scandinavian countries setting a model example—providing the strongest protection worldwide.

45. Human rights by default. Terms of service should move away from a discretionary approach rooted in generic and self-serving “community” needs. Companies should instead adopt high-level policy commitments to maintain platforms for users to develop opinions, express themselves freely and access information of all kinds in a manner consistent with human rights law.125 These commitments should govern their approach to content moderation and to complex problems such as computational propaganda126 and the collection and handling of user data. Companies should incorporate directly into their terms of service and “community standards” relevant principles of human rights law that ensure content-related actions will be guided by the same standards of legality, necessity and legitimacy that bind State regulation of expression.127  46. “Legality”. Company rules routinely lack the clarity and specificity that would enable users to predict with reasonable certainty what content places them on the wrong side of the line. This is particularly evident in the context of “extremism” and hate speech, areas of restriction easily susceptible to excessive removals in the absence of rigorous human evaluation of context. Further complicating public understanding of context-specific rules is the emerging general exception for “newsworthiness”.128 While the recognition of public interest is welcome, companies should also explain what factors are assessed in determining the public interest and what factors other than public interest inform calculations of newsworthiness. Companies should supplement their efforts to explain their rules in more detail with aggregate data illustrating trends in rule enforcement, and examples of actual cases or extensive, detailed hypotheticals that illustrate the nuances of interpretation and application of specific rules.

Free speech orgs are denouncing the move to community notes instead of working with fact-checking orgs. I wonder what they make of Bluesky's announcement that it too was going to implement a community notes-like feature. Shouldn't they denounce that too as being anti-free speech?
This helps you maintain control over a thread you started, ideally limiting dog-piling and other forms of harassment. On the other hand, quote posts are often used to correct misinformation too. To address this, we’re leaning into labeling services and hoping to integrate a Community Notes-like feature in the future.

A negative response among Christians resulted from Martin Scorsese's film, ''The Last Temptation of Christ.'' Although most of us were willing to honor First Amendment rights and let the fantasy be shown, the sacrilegious scenes were still distressing to me and many others who share my faith. There is little doubt that the movie producers and Scorsese, a professed Christian, anticipated adverse public reactions and capitalized on them.

''The Satanic Verses'' goes much further in vilifying the Prophet Mohammed and defaming the Holy Koran. The author, a well-versed analyst of Moslem beliefs, must have anticipated a horrified reaction throughout the Islamic world.

The death sentence proclaimed by Ayatollah Ruhollah Khomeini, however, was an abhorrent response, surely surprising even to Rushdie. It is our duty to condemn the threat of murder, to protect the author's life and to honor Western rights of publication and distribution. At the same time, we should be sensitive to the concern and anger that prevails even among the more moderate Moslems.

Ayatollah Khomeini's offer of paradise to Rushdie's assassin has caused writers and public officials in Western nations to become almost exclusively preoccupied with the author's rights.

While Rushdie's First Amendment freedoms are important, we have tended to promote him and his book with little acknowledgment that it is a direct insult to those millions of Moslems whose sacred beliefs have been violated and are suffering in restrained silence the added embarrassment of the Ayatollah's irresponsibility.

Argentina's bonds have already rallied dramatically. One gauge of the nation's hard-currency debt, the ICE BofA US Dollar Argentina Sovereign Index, has generated a total return of about 90% this year.

Meanwhile, the S&P Merval Index has risen more than 160% this year through Monday, far outpacing stock benchmarks in developed, emerging and frontier markets alike. Adjusting for currency differences, the index is still up more than 100% in U.S. dollar terms. For comparison, the S&P 500 is up 25% over the same period.

In his speech at the event, Mr. Modi stressed the importance of strengthening the spirit of love, harmony and brotherhood in line with the teachings of Jesus Christ.
