Our statement on the EHRC Code of Practice.
Today, the new EHRC Code of Practice comes into force, excluding trans people from services and facilities they have used without issue for decades.

This guidance is discriminatory, unworkable, and makes everyone less safe. It will have a devastating impact on trans people’s day-to-day lives.

Equalities law needs to change to restore trans people’s rights. We will never stop fighting for a society where trans people are free to live openly and without fear.

Dear Bridget,

Re: the EHRC's statutory Code of Practice

The EHRC's new Code of Practice was supposed to give people and organisations clear and workable guidance to protect everyone from discrimination, harassment and victimisation.  After studying it carefully, I'm afraid we have to conclude that it has failed that test.

We have heard from many people across our society who are deeply concerned about what it will mean for them as they go about their daily lives.  We have also heard from businesses and charities who still don't see how they are supposed to implement the code while complying with their existing duties to customers, clients, and staff.

These concerns are naturally most acute among trans, non-binary and intersex people.  They understandably fear that this guidance could lead to them being shut out of vital services and unable to go about their daily lives.  As the government's own impact assessment says, "trans people could be barred from the space aligned with their gender and the space aligned with their birth sex, effectively leaving them with no service at all."  They are also concerned at the risk of being forced to out themselves unnecessarily, and the increased threat of being harassed, abused and attacked just for being who they are.

But the risks of this guidance go much further.  We have heard from many women who fear the rise of "gender policing", where they are accused of not looking "feminine enough" and challenged to "prove" their sex - just to access the women's services and facilities that are their hard-won right.[the second page of a letter on House of Commons headed paper, with Marie Goldman MP's email address in the footer]

The letter reads:


Businesses, charities and other organisations have also raised concerns about the costs of complying with this guidance, and the legal uncertainty they face.  This guidance was supposed to provide clarity, but instead the confusion it creates - including over how it interacts with other legal duties - only increases the threat of complicated and expensive legal cases against organisations who are just trying to do their best.

For all these reasons, we do not believe that the new Code of Practice is fit for purpose.  It does not provide clear and workable guidance, and it does not do enough to protect everyone from discrimination, harassment, and victimisation.

More than that, we do not believe that this guidance is compatible with the longstanding British values we hold dear: tolerance, decency, respect for individual liberty and the rule of law.  We do not want to become a country where people are barred from accessing essential services simply for who they are, or where women are asked to prove that they are women, just to go about their lives.

The truth is that the issues that are now so sensitive and contentious were never discussed in Parliament when the Equality Act was passed 16 years ago.  Now, we fear the government is seeking to compound that by imposing this new guidance without any real debate or scrutiny in Parliament.  That is wrong, and undemocratic.  It is past time for Parliament to step up and grapple with these issues properly.

We therefore urge you to withdraw the guidance, and instead support our proposal for a joint committee of cross-party MPs and peers to conduct post-legislative scrutiny of both the Gender Recognition Act and the Equality Act 2010, taking evidence from all communities who have been impacted in order to propose amendments or new legislation it sees as necessary to ensure existing [con't][the third page of a letter on House of Commons headed paper, with a footer showing Marie Goldman MP's email address]

Thank you to @mariecgoldman.bsky.social for her speech yesterday in the Commons. The dignity and rights of trans people must be ensured in this guidance, and she is right when she says that trans rights and women's rights are not and will never be competing objectives.
The Minister must ensure that the new guidance is workable and inclusive. The Liberal Democrats will accept nothing less.

It must lay out how it will protect the dignity, safety and rights of all, and ensure that trans people are not prevented from participating in public life because there are no facilities that they can safely use.

It is also essential that the guidance is subject to full parliamentary scrutiny. It must have a full debate and free vote.

Women & Equalities SpokespersonTo deal with the unacceptable legal limbo that many trans people are in, I encourage the Minister to appoint a Joint Committee of MPs and peers, on a cross-party basis, to conduct post-legislative scrutiny of both the Gender Recognition Act 2004 and the Equality Act 2010.

The Committee should take evidence from affected communities, including trans people, and propose any amendments or new legislation that it sees as necessary to ensure that existing rights are protected.

LGBT+ Lib Dems back calls from Lib Dem MPs to propose amendments to the Equality Act that protect trans rights, and ensure that trans people have a voice in that process.

Following the recent High Court decision concerning the challenge brought by the Good Law Project to EHRC interim guidance, I am writing to express my disappointment at the continued uncertainty surrounding the practical implications of last year’s Supreme Court ruling.
While the Court has ruled on the question of standing in this case, it is clear that the wider issues remain far from settled. Trans, non-binary and intersex people continue to face profound anxiety about what these developments mean for their daily lives. Meanwhile, employers, service providers and public bodies tell us they still lack clear, workable direction about their responsibilities under the Equality Act 2010.
This persistent uncertainty benefits no one. It risks leaving trans or gender non-conforming
people worried about being excluded from facilities they have used for years, and organisations exposed to confusion, legal risk and unnecessary cost. You have repeatedly stated that trans people remain protected from discrimination. Without clear guidance, however, that statement offers little reassurance to those directly affected.I urge you to bring forward new, workable, and inclusive guidance as a matter of urgency, and to lay any new EHRC code of practice before Parliament so it can be properly scrutinised and debated. There must be a rigorous democratic process, including a free vote, to assess whether the proposals genuinely ensure dignity, safety and inclusion for trans people while upholding the rights of women.

I also urge you to appoint a joint committee of cross-party MPs and peers to conduct post-legislative scrutiny of both the Gender Recognition Act and the Equality Act 2010, takinh evidence from communities who have been impacted including trans people, which will propose any amendments or new legislation it sees as necessary to ensure existing rights are protected.

The Liberal Democrats are clear that everyone deserves to feel safe, respected and free to be who they are. Protecting the rights of women and ensuring dignity and inclusion for trans people are not competing objectives; both are essential to a fair society. Your Department must now provide leadership and certainty to achieve that balance.

I would welcome an update on your timetable for publishing revised guidance and laying it before Parliament, and would be grateful for the opportunity to meet to discuss these matters further.

Today is World AIDS Day. We have come a long way since the horrors of the 1980s, which triggered a wave of homophobia which has its echoes today. HIV is now routinely treatable and for the first time there is the prospect of a world without AIDS too. (1/2)

Statement on the Suspension of Trans-Inclusive Quotas

"We are disappointed that, due to legal pressure from transphobic campaign groups following the For Woman Scotland decision, two eminently reasonable quotas in our party's election regulations have been suspended. These suspensions are profoundly anti-queer, anti-trans and anti-feminist, and those threatening to sue clearly care about trans exclusion and not women’s liberation.

Several months ago, well before the elections, we advised the party that we supported the existing trans-inclusive gender quotas and that the only viable alternative in the face of legal threats would be to suspend gender quotas, despite this being completely against our values. The attempt to instead third-space trans people has wasted a huge amount of staff and volunteer time and effort, not to mention money that should have been spent on Liberal Democrat campaigning.

We continue to advocate for changing the law to reverse the effects of the For Women Scotland decision. We are also working across the party to develop constitutional proposals to bring back the suspended quotas, particularly the LGBT+ quota, to the fullest extent possible."

The last two weeks have been a tough one for @libdems.org.uk members, through no fault of their own. We're grateful to the huge number of members, internal election candidates, and fellow Affiliated Organisations like @libdemwomen.bsky.social who have stood alongside us. Statement below:
Statement from LGBT+ Liberal Democrats:
The Co-Chair of the LGBT+ Liberal Democrats recently had the opportunity to meet with the barrister who issued the legal advice underpinning the Returning Officer’s decision to make the party’s gender quotas trans-exclusionary.
The KC had advised that, after nominations for the internal elections closed, no legal avenue would remain available for either keeping gender quotas trans-inclusive or suspending them. Other legal experts take a quite different view, and this raises concerns about the party’s position.
LGBT+ Liberal Democrats:
•	Thank the candidates and AOs that stand alongside us in this struggle.
•	Believe that it is completely unacceptable that the decision to modify gender quotas was delayed until after the close of nominations, restricting the party's options according to their own legal advice.
•	Believe that UK law must be changed to restore the rights of trans people, in line with the original intent of the Equality Act 2010, as described by its drafters, and in line with the Goodwin v UK (2002) decision.
•	Welcome efforts by trans and non-binary members and their allies to test the party's position via the party’s internal appeals processes, and, if necessary, through legal action. We await the full detail of today’s FAP decision.
•	Will work across the party over the coming weeks and months to develop constitutional proposals that secure trans-inclusive gender quotas and ensure trans-exclusionary gender quotas can never again be imposed.
LGBT+ Liberal Democrats remain committed to fighting to secure the liberty and dignity of trans and non-binary people in the UK, and to fighting to uphold the will of Conference within our own party.

Today is Intersex Solidarity Day. Intersex people are a distinct and uniquely vulnerable minority who face specific issues in life. Lib Dem policy, as passed this Spring Conference, calls for a ban on medically unnecessary, non-consensual treatments or surgeries for intersex infants and children.

The RO in our internal elections has sent this update round. It is nowhere near good enough: trans and non-binary candidates should never be third-spaced in this way. The gender quotas in Article 2.5 of the party Constitution should be implemented as-written - or suspended if they can't be. 1/2

Ming Campbell was one of the most influential Lib Dems of the last few decades - his opposition to the Iraq War inspired a whole generation of Lib Dems to join, and his allyship on LGBT+ matters was always both strong, and appreciated. He was also remarkably kind. We will miss him.

On the 7th of June, 1954, Alan Turing died. He was discovered the following day. His birthday would have been the 23rd of June. He had opted for chemical castration following his conviction for homsexuality and indecency. Now, of course, we celebrate June as Pride Month. 1/3

The collapsed Tretten timber bridge in Norway.  A wide, turquoise river with green banks with pine trees and scattered buildings is crossed by a road bridge with a large wooden frame, which has collapsed into sections with a car sticking sadly out of one end, causing whitewater downstream in the river.  No-one was hurt in the collapse and the car drivers involved were both rescued.
