As you'll recall, a number of the Collectable items were recently auctioned at Heritage Auctions...and there's concern about what will happen to that money once Collectable gets it.

Nonetheless, in one of those cases, the plaintiff moved for default judgment (because Collectable did not timely respond to the complaint) AND asked for the appointment of a receiver to "exercise discretion over the $11.5 million in auction proceeds."

Quick update on the Collectable cases. As I've tweeted out before, there are two of these cases ongoing...and Collectable's attorneys have moved to withdraw, which kinda puts these cases in limbo.

Now, this motion really focuses on the Collectable defendants...not Heritage...but in a footnote, the plaintiff asks the court for discovery into whether Heritage was involved with this alleged scheme.

What's really fun here also is that the alleged settlement agreement is attached to the filing!

If all this is true, it sheds light on the Collectable defendants' counsel moving to withdraw in these cases. And as the filing states, the plaintiff "firmly believes that counsel to the Collectable Defendants was an unwitting victim of her clients’ scheme."

With this motion, the plaintiff is now asking the court to get the money BACK from Collectable to Heritage...or for the immediate performance of the settlement agreement.

To state another way, the filing alleges Collectable duped the plaintiff, the court, and Collectable's attorneys with a ruse of a settlement agreement so it could "abscond" with the money from the Heritage auction.

The filing then alleges Collectable "never intended to comply with the...Settlement," rather, the purpose of the settlement was so the hearing would NOT take place so they would receive "distribution from Heritage of the very funds and property that was at issue in the Motion."

The settlement allegedly was for $205,000...and everyone lived happily ever, right? NOPE! Because the settlement payment was allegedly "not made." Not only that, but the Collectable defendants' attorneys were "withdraw[ing] as counsel" in this case as well.

So, the filing we'll be talking about today is the plaintiff's reply in support of his motion for a TRO/PI...and it gives us a brief recounting that the hearing was to be on Sept. 18...however...the hearing was canceled because the parties allegedly reached terms for settlement.

Oh! Actually before that, there is another Collectable case out there...and as I tweeted recently, Collectable's attorneys moved to withdraw basically for "irreconcilable differences"...which were not explained in the filing.

As to where we are in that litigation, the plaintiff moved for a temporary restraining order to stop Heritage from providing Collectable/Neuman the money from auctioning the Collectable items. That hearing was supposed to be on Sept. 18...which leads us to today's update.

For this particular suit, the plaintiff alleges he is entitled to no less than $600,000 for the assets he fractionally invested in, some of which were sold by Heritage Auctions recently.

And that's about it for the update! It'll be interesting to see what happens next, as courts don't always let lawyers pull the ripcord until replacement counsel is in place especially here where corporations CANNOT represent themselves in court without counsel.

NOW, this is notable because as you may remember, in prior litigation, Collectable's attorneys withdrew there too...though for the alleged lack of payment. To be clear, this new motion does not rely on lack of payment as the cause; it focuses on "irreconcilable differences."

Heck maybe there'll be an opposition or hearing on this and we'll learn more...but courts bend over backwards to preserve the attorney-client privilege, so we're unlikely to learn more.

Now, with the chosen language here attorneys who have litigated for a bit are sure to try to read between the lines and generally surmise what's happened, BUT, I'll leave that for everyone's speculation at this point.
