„Shadow Database“-Scandal:

noyb lawsuit now certain, interest list for class action openedIn mid-July, investigations by NDR and the SZ revealed that the German credit information agency SCHUFA stores millions of data records that should have been deleted long ago. It has since become clear that SCHUFA also uses this data for its customers’ ‘testing purposes’.

Potentially, all 69 million people on whom they hold data are affected. And even in response to access requests under Article 15 GDPR, the company refuses to disclose this historical data.Two weeks ago, noyb sent a cease-and-desist letter, while at the same time announcing that we would bring an injunction should the credit reference agency refuse to comply.

SCHUFA’s deadline has now expired. In a public statement, it has rejected the allegations. Therefore, it is now certain: noyb will file an injunction.

Civil society coalition urges EU to kill the cookie banner.For once, EU legislators have an opportunity to deliver genuine simplification for people: a solution to the ongoing issue of misleading cookie banners.

As part of its highly controversial Digital Omnibus package, the EU Commission has proposed legally binding automated privacy signals.These would allow you to set your privacy preferences once, and very rarely see another banner. Unfortunately, the tracking industry is pushing back.Therefore, a coalition of currently 
19 civil society organisations, businesses and academics has joined forces. We urge the Commission, the Council and Parliament to support automated signals for privacy choices and a strong Article 88b in the Digital Omnibus.

„Schattendatenbank“-Skandal:

noyb mahnt SCHUFA ab, Interessentenliste für Sammelklage eröffnetMitte Juli wurde durch Recherchen des NDR und der SZ bekannt, dass die SCHUFA Millionen Datensätze speichert, die längst gelöscht sein müssten. Inzwischen steht fest: Die SCHUFA verarbeitet diese Daten sogar zu „Testzwecken“ ihrer Kunden. Betroffen sind potenziell alle 69 Millionen Menschen, zu denen die SCHUFA Daten hat.

Und die SCHUFA mauert dabei weiterhin: Selbst bei formellen Auskunftsersuchen nach Artikel 15 DSGVO beauskunftet sie diese historischen Daten nicht.Angesichts der klaren DSGVO-Verstöße hat noyb die Wirtschaftsauskunftei nun abgemahnt und eine Unterlassungsklage angekündigt.

Betroffene, denen die SCHUFA ihre historischen Daten vorenthalten hat, können außerdem ihr Interesse für eine zukünftige Sammelklage auf Schadenersatz melden.

1,741 “informed” consents with one click?! GDPR complaint against dict.cc filedToday, noyb has filed a complaint against the popular online dictionary dict.cc.

The GDPR requires that consent is freely given, informed, specific and unambiguous. However, when visiting dict.cc, users are nudged into consenting to online tracking by a staggering 1,741 (!) “partners” with a single click.This makes it impossible for users to know exactly who has access to their data and how it is actually used.

While dict.cc is an extreme example, requests to blindly waive your right to privacy for countless third parties is unfortunately a common issue with websites and apps relying on online advertising, even 8 years after the GDPR came into force.

EU Member States (and Google) suddenly want to keep cookie banners!For years, users and many companies have been complaining about cookie banners.

Even though this under-standable frustration is mostly caused by misleading dark patterns used by the industry, these banners have become the symbol of what is perceived as excessive EU regulation. As part of the ‘Digital Omnibus’, the European Commission now finally wanted to get rid of cookie banners and replace them with an automated signal.

However, Google and some EU Member States – including Germany and France, for example – are now standing in the way. In the Council’s latest position paper of 18 June, the plan to abolish the cookie banner has been scrapped.

This baffling outcome is likely to continue to cost European users a great deal of hassle, frustration and billions of clicks per year.

noyb success: ORF.at must correct misleading cookie bannerThe Austrian Broadcasting Corporation (ORF) must amend its cookie banner on ORF.at to bring it into line with the GDPR. This has now been decided by the Federal Administrative Court (BVwG), thereby upholding a decision made by the Austrian Data Protection Authority in 2024.Specifically, the ORF must ensure that the buttons to ‘accept’ or ‘reject’ tracking cookies are designed equally so that visitors are not tricked into agreeing. Currently, the ‘Accept’ option is misleadingly highlighted in colour, which can lead to unintended consent.
