The Limits of Universal Justice
How America’s War on the International Criminal Court Exposes the Contradictions of the Rules-Based Order

A multipolar world will not automatically produce more universal justice. It could simply produce more powerful states claiming exceptions for themselves. The future of international law depends on whether rules can constrain power, not merely serve it.

International law faces structural contradiction. Powerful states invoke sovereignty when accountability threatens them, but demand international justice when adversaries violate law. Stephen Krasner called sovereignty "organized hypocrisy." The ICC controversy gives that phrase renewed relevance.

Caribbean adds another dimension. US strikes against suspected drug-trafficking vessels have raised serious legal questions. Not every unlawful killing is an ICC crime. Jurisdiction matters. But Washington has reportedly sought protection against future ICC investigations of Trump and his officials.

By September 2026, the US had sanctioned 9 of the ICC's 18 judges. Half its judiciary. These sanctions can disrupt banking, travel, and professional life. When judges face financial punishment for exercising jurisdiction, the issue becomes judicial independence itself.

Neither Russia, Israel, nor the US has joined the ICC. But consider this: If a foreign citizen commits murder in Portugal, Portuguese courts can prosecute them. The ICC follows a related territorial principle: nationality alone does not shield suspects from jurisdiction.

The US welcomed the ICC's pursuit of Vladimir Putin over alleged crimes in Ukraine. But when the same Court issued arrest warrants for Benjamin Netanyahu and Yoav Gallant, Washington imposed sanctions. Different conflicts. Different allegations. Should the legal principles change?

For years, the ICC faced criticism for prosecuting African leaders while powerful states escaped scrutiny. Then its investigations expanded to Afghanistan, Palestine, and Ukraine. The Court began confronting a different problem: what happens when international justice reaches powerful states?

Mukum | Political Analysis @mukumsays.bsky.social · 12/10/2026
American hostility to the ICC did not begin with Trump. In 2002, Congress passed the American Servicemembers' Protection Act, nicknamed the "Hague Invasion Act." It authorized extraordinary measures to free certain Americans detained by the ICC. Exceptionalism became law.

At Nuremberg, Nazi leaders were prosecuted for crimes against humanity. But the victors were never subjected to equivalent scrutiny. International criminal justice began with a paradox: universal principles, enforced through an unequal distribution of power.

Mukum | Political Analysis @mukumsays.bsky.social · 12/10/2026
The US helped build the modern system of international justice. Now it is sanctioning the judges who enforce it. What happens when the architects of international law refuse to be governed by it? A thread on power, sovereignty, and the limits of universal justice.

Thousands gather in London to express support for Palestinians after three years of ‘genocide’
March is first since Ed Miliband declared UK’s position was that Israel’s occupation of West Bank was unlawful Thousands of people have gathered in central London to express their support for Palestinians after three years of “genocide” carried out against them by Israel. The demonstrators, many wearing keffiyehs and holding Palestine flags, gathered on the Embankment at midday on Saturday. Some carried placards reading “End the genocide” and “Free Palestine“ as they marched towards parliament. A bride and groom appeared to be among those in attendance and a two-minute silence was held to reflect on the lives lost in Gaza. Continue reading...

Violations of child labor laws are on the rise in the U.S. But since 2021, 30 states have proposed legislation that would roll back child labor protections and regulations, with 17 states enacting rollbacks. Most of these states are controlled by Republicans. So much for protecting children.
