I think Jack Smith has a case. He’d have to prove "actual malice" under New York Times v. Sullivan. This requires proving that Schmitt either knew the statement was false or acted with reckless disregard for the truth.

I say: sue for defamation. Speech and Debate Clause: Article I, Section 6 of the U.S. Constitution protects members from lawsuits for statements made during official legislative proceedings, such as floor speeches or committee hearings. Outside the Chamber is unprotected. Legally actionable.
