Frankly, our court’s scorched-earth approach to the 
Second Amendment is getting exhausting. I haven’t even 
been on the bench for that long, and I’ve lost count of the 
number of dissents that I’ve written in cases like this one, 
which is just another verse of the same boring song. I highly 
suspect that, before too long, the name of this case will have 
a red flag next to it on Westlaw, just like so many of our 
court’s other Second Amendment cases do. But hopefully 
next time, when the Supreme Court plants that flag, it will 
do so with a little more bite than it has before. Until then, I 
will assiduously but wearily dissent.

This fall the Supreme Court will hear a case on whether the 2nd Amendment permits states & localities to ban assault weapons, like the AR-15. You'll hear a lot about how "only" 11 states have such bans. But their combined population is more than 115 million, subjecting 1 in 3 Americans to such laws.

Third Circuit also upholds federal machinegun ban and silencer registration requirement against 2A challenges. All federal appellate courts to have heard a challenge to the machinegun ban have upheld it. Sure seems like these judges don't think prevention of tyranny is a factor in 2A analysis.

Fed dist ct upholds Hawaii ban on 18-to-20 year olds owning firearms, continuing a recent pattern of courts upholding age limit laws on gun purchases. And a pattern of upholding such laws when courts use historical limits on minors' contracting rights at common law as evidence of constitutionality.

This is an important case. Demonstrates multiple ways that illegal straw purchasers signal their intentions to sell or transfer their guns to people who can’t legally purchase guns. Dealers can spot these, deny the sale and report it to law enforcement. Make the dealers pay if they don’t.

Standing up for the right to be safe shouldn’t put one’s own safety at risk. Wanting to end violence and build safer communities shouldn’t elicit a response of hateful abuse. Holding a community meeting after a shooting should be able to happen without fearing who will show up to cause trouble. 3/

Fleet Farm in Blaine, Minnesota sold a Mossberg MC2c pistol to a man who bought over two dozen guns from the store in just four months, including eight in a single week. The pistol was later used in a mass shooting that killed one woman and wounded 14 others.

This past term, Minnesota enacted laws to ensure those convicted of DV crimes or subject to DV protection orders surrender their firearms, as required under federal and state law. The new law mandates courts to hold compliance hearings to ensure surrender occurs. www.mprnews.org/story/2026/0...

Okay, so now that I've finished all the opinions and thought about it more, here are some of my takeaways: 1) This opinion is a disaster. It changes a bunch of the Bruen methodology, sometimes in subtle ways, but all in ways that make it *much* more difficult for legislatures to regulate guns.

I think Alito tying Rahimi to the “nuanced“ Bruen approach because it regulated “distinctly modern conduct” creates some daylight for some of these on the second step. Technological development of weapons tied with the rise of mass shootings should allow for a higher level of generality.

Wolford: the one where Alito rewrites the prior Second Amendment cases. He claims Heller "emphatically rejected" interest balancing ... and yet 1500 lower court opinions and all of the federal Courts of Appeal applied interest balancing in the 12 years between Heller and Bruen.
