i think this is my fundamental issue with those provisions... there is a yawning gap between what in this case gov thinks is restricted data and what a user agent (traditional sense) sees as restricted data. unless your website returns 403 Forbidden, how am I to know I shouldn't be in there!

If the government is pondering legal action against OpenAI they’ll soon discover the incident won’t meet the threshold for criminal liability. So they’ll go for legislative amendments, which will attempt to recategorise Google dorking and webscraping as unlawful. Bad outcome

Does scraping file names and directories exposed to the Internet via forward a facing server meet the definition of hacking? Because many, many researchers have used Google dorking and webscrapers and have never faced legal consequences. Because it didn’t meet a threshold for prosecution
