Skrmetti is a cowardly piece of work. It won't face the one thing everybody knows about these laws; they are driven by opposition to trans people. The Court dodges that central fact with the kind of word games that make people hate lawyers. Its a sure sign their hearts know they are doing wrong.

Mistakenly thinking the same standard needs to be met, District Judges have started issuing stays pending a greater legal/factual showing. Should not be needed for a TRO

Part of what’s going on is a misunderstanding of TROs. Some DC District opinions say the Prelim Inj standard applies to TROs. Correct it’s the same factors. But not the same showing, which would be virtually impossible on a TRO.
