Pero, explican, sí es procedente “advertir sobre la ligereza en el uso de tales sistemas, en la medida en que, por la comodidad que propician, y por la fascinación que sobre todo inicialmente producen sus habilidades sintácticas, de redacción y discursivas, pueden acabar dando como resultado un texto salpicado de frases brillantes que no dicen mucho, que se alejan de la cuestión concretamente controvertida en el caso, envolviéndola en consideraciones y razonamientos sólo aparentemente referidos al caso y cuya brillantez sintáctica encubre un vacío de densidad jurídica. A cualquiera le gusta suscribir un texto bien escrito, pero lo importante es cuidar de que ese escrito sea eficaz para el objetivo que le es propio”.

Aun cuando no es fácil determinar cuándo un texto ha sido concebido, preparado y/o redactado con IA, no tiene sentido esforzarse en investigarlo cuando se trata de una alegación de parte, pues su uso es “absolutamente legítimo”. Así, consideran que la premisa es que el letrado “asume personalmente el texto en todos sus puntos y referencias”. Sin embargo, señala, hay determinados patrones expresivos perfectamente identificables como indicios de redacción por IA. Ante tales indicios perceptibles, llaman la atención “de que una redacción más cuidada y personalizada muy probablemente hubiera reducido a como mucho la mitad la extensión del escrito, ganando fuerza argumentativa y sin desmayarse en circularidades que, en general, simplemente sobran, y en particular, en algún caso, comportan falacias, sofismas o simple énfasis de palabras, inhábil desde el punto de vista de la finalidad de convencer a un tribunal de una tesis determinada”.

for folks less familiar with FOSS: this is why open-source software is often more secure. the public repo history helps prevent bad actors from contributing code the rest of the community disagrees with. a private codebase can just add surveillance tech with zero warning until it is fully live.
