Even if it's as much as political question as a legal question, it results in Canada asserting that Netanyahu is free to use our airspace, & perhaps interpreting the Rome Statute to claim that is a valid position (though again they haven't said so), & creating impunity in the air for ICC suspects.

I also understand the point about 89.3(d), but I think the more instructive point is that seeking permission by a foreign *is* required by Canada, creating an opportunity to decide whether the state is okay or not with a wanted ICC suspect entering its airspace.

It's also a matter of our sovereignty whether Canada is okay w an #ICC suspect crossing its territory. Spain, Slovenia, Turkey, etc. are all not. We are not for Russian aircraft, but apparently ok w Netanyahu. Ottawa won't even say if it approves these overflights, let alone its legal position.

It's a good point regarding whether a request has been made or not. We don't know. Territory, also according to the OTP, includes airspace. Also, hard to know as Canada won't say if it sees its obligations as extending to its airspace or even whether we have approved overflights.

Very good and significant news in the display and international justice world. The #ICC Assembly of States Parties will not be held at the UN in New York, but in The Hague. There’s no way America was going to be rewarded for its behavior and no way participants could be safe.
