This week has seen front page coverage of crypto billionaire Reform donor Ben Delo’s funding of neo-Nazis Nina Power and DC Miller in my High Court antisemitism case, in the Financial Times and the Guardian, as well as excellent in-depth reporting by the Byline Times (links below).

As Ben Delo's record £36m Reform donation is headline news, I can't emphasise enough that the media ought to be reporting on Delo's heinous funding of antisemitic conspiracy theorists in the High Court – anonymous contributors to the horrifying neo-Nazi account shown below. bsky.app/profile/luke...

Yes, indeed – Toby Young was one of those promoting the neo-Nazis' dishonest crowdfunder against me from the outset.

Worth noting too how Reform's James Orr—disgraced by Verbatim's Channel 4 exposé—leapt to Nina Power's defence (alongside Kathleen Stock) following the damning judgment and her unmasking as antisemitic conspiracy theorist and anonymous contributor to a notorious neo-Nazi account.
James Orr: "Nina Power is a talented and valuable voice in the postliberal space, so I can understand why progressive authoritarians are so desperate to cancel her; but it's not going to work."

Kathleen Stock: "@Nina_Compact is an original, stimulating, light-footed writer who always makes me think; I'm very happy I supported her crowdfunder a few years back; and I get a lot from @compactmag where she is editor…"

The Ineffable Horror of Joe Muggs: "James, she made sure her Nazi sympathies would be publicised when she tried to silence - "cancel" if you will - a critic who she'd been subjecting to Antisemitic bullying. Help me out. Can you explain how the marketplace of ideas has failed here exactly? Because I'm CONFUSED."

Oh yes – Fox's Battle of Ideas festival receives funding from Ben Delo (£100k/year per the Guardian), who also spent £350k funding Nina Power's wretched case. The key "ideas" being supported there were Holocaust revisionism, and the notion that it's "cancel culture" to oppose the targeting of Jews…
In the Sanctuary offices a framed picture of Delo, a gift from the Academy of Ideas, founded by Claire Fox, contains a written thank you to “our free speech hero”. The Academy uses one of the rooms as an office, and the Guardian understands Delo has provided £100,000 a year to fund Fox’s Battle of Ideas festival, which holds debates tackling the “free speech emergency” and “cancel culture”. Its marketing material credits the Ben Delo Foundation as a supporter.

Yep, depicting Jewish people as reptiles is a vicious antisemitic trope that goes back centuries, and one that the Parallax Optics account was particularly fond of. (See also David Icke.)

Daniel Miller: What do they run? They run some things...

Nina Power: Was unfortunate....also a question about Tommy Robinson in the quiz which perhaps a surprising number of people playing took as an opportunity to sing TR's praises. Paul was like 'Rothschilds, tentacles' etc

Daniel Miller: Did you ever read Kevin McDonald Culture of Critique? He's probably got the most sophisticated anti-Semitic theory

Nina Power: I did not. I am really not very up on philo or antisemitism or Judaism at all unfortunatel

Daniel Miller: ((Nathan Cofnes))) wrote a pretty good critique of it a while back...

Daniel Miller: Many things that one could say about this topic ultimately but of course it's not so easy to discuss

Periodic reminder that Kathleen Stock unapologetically crowdfunded for neo-Nazi bullies in their calamitous libel case against me.
Tweet by Kathleen Stock sharing a far-right crowdfunder by Daniel 'DC' Miller and Nina Power entitled 'Targeted, harassed and falsely labelled a fascist'.

Reply by Mallory Moore: "Seriously, why are you supporting a *not even very well veiled* fascist here? This feels reminiscent of the way you've supported the work of homophobes and not once let your following know maybe that was a mistake. Why do you keep doing this?"

Reply by Kathleen Stock: "Stop believing all you read online about people. And stop casually debasing the word "fascist" for role playing purposes - one day you might be unlucky enough to meet a real one."Tweet by Kathleen Stock: "Nina [Power] is an original, stimulating, light-footed writer who always makes me think; I'm very happy I supported her crowdfunder a few years back; and I get a lot from @compactmag_ where she is editor, and the podcast she contributes to. Keep doing what you do Nina, you are great."

Reply by Will: "Apart from the Neo-Nazi shit, sure". Embedded tweet by Luke Turner including antisemitic imagery: "During cross-examination, Nina Power & Daniel Miller both admitted they had written anonymously for the Parallax Optics site--a fact they had previously denied--with their *own pleadings* having characterised the account as "espousing and disseminating abhorrent antisemitic views."

Reply by Kathleen Stock: "Whatever the deeper truth here, I absolutely would not take Turner's word for it. And I would say more, but the last time I mentioned his name on Twitter, fairly benignly, I got threatened with legal action."

Reply by Will: "*Deeply* embarrassing tweet when you can literally read the judgment". In describing Nina Power & Daniel Miller's "bullying" conduct towards me, the judge singled out the manner in which their litigation was conducted and my cross-examination at trial—a truly horrific ordeal that saw me interrogated on my "Jewishness" by the antisemites' barrister.
This could, on an objective basis, fairly be described as bullying. It was asymmetrical. Mr Miller and Ms Power found Mr Turner’s views offensive, and his labelling of them personally offensive, but he did not express himself in an offensive manner. They considered his viewpoint unreasonable, but he expressed it moderately, rationally and on a reasoned basis, with a view to engagement and eliciting answers to questions or challenges. As already noted, Mr Turner’s side of the interactions is recognisable as an exercise in ‘calling out’ – that is, an exercise in labelling Mr Miller’s and Ms Power’s words and deeds (and others’), on the basis of what is entirely apparent was his genuine and articulated belief that they merited those labels. Their response was to attack him. They did so persistently. (I observed a little of the flavour of this myself in their conduct of this litigation, in their oral evidence, and in the choices made, presumably on instruction, about the cross-examination of Mr Turner. He responded, and assisted the court, with presence of mind and composure.)

The piece raises the question of whether Mark Lewis ever notified my solicitors of third-party funding in the case. The answer is no. In fact, it was categorically denied. It was only Nina Power's bankruptcy that uncovered Ben Delo having paid £350,000 directly to Patron Law.
Letter from Patron Law's Mark Lewis to my solicitors:

"There is no third-party funding the litigation. Our client is entitled to borrow funds in order to pursue litigation and to defend those claims brought against her.

You are not entitled to go behind privilege to determine why we and counsel have indicated that we are no longer prepared to act under a CFA, whether it is due to the merits of her case, or your client’s counterclaim, or simply a recognition that your client might not have sufficient funds to meet a costs order, is a matter between us and our client."

Timely analysis by James Wilson on the legal ramifications of crypto billionaire & Reform donor Ben Delo's £350,000 funding of antisemitic "bullies" Nina Power & Daniel Miller in the High Court, and a pattern of unlawful conduct by Patron Law's Mark Lewis: perincuriam2.substack.com/p/episode-16...
Because Mr Lewis was acting on CFAs at this stage, it appears that he and Patron Law were not charging their clients who dabbled in anti-semitism. And the only way Mr Lewis could get paid was if the Jewish person they had bullied either: gave in by settling their claims; or lost at trial. Unless their fascist-curious clients won, Mr Lewis and Patron Law were effectively acting for them for free.

This position changed, though, on 9 March 2023 when a further notice of funding form was filed at court which showed that Ms Power’s CFA had been terminated. Although Ms Power’s CFA with Patron Law ended, Mr Miller’s continued. There is a bit to unravel here, and the starting point is that Mr Ben Delo, the billionaire who co-founded BitMEX, a crypto-currency exchange and trading platform applied to register a charge on Ms Power’s house and then around £350k was paid to Patron Law in March 2023 towards Ms Power’s costs in the litigation.Ben Delo

At trial, Daniel 'DC' Miller—a writer for neo-Nazi site Social Matter, which called for the "segregation & separation" of Jewish people—refused to acknowledge Nick Land's appalling antisemitism, such as his grotesque claim that it was "the poor dim Jews who get disproportionately shoah'd".
Q. 2979 is the page. Now, Outsideness is the Twitter account of Nick Land, is it not, someone you followed?
A. Mm hmm.
Q. And this says, "Antisemitism is most likely a Jewish conspiracy. Nobody else could make a political theory that Baroque sound plausible to people".
A. Mm.
Q. That was from 2015, so that is a view expressed by another account that you follow, correct, which is, would you agree, antisemitic?
A. I think it's quite a complex statement which Nick Land is making here.
Q. Is it antisemitic?
A. I think it's an ironic statement about - first of all he says that antisemitism is a Baroque theory.
Q. Could you just answer the question? Is it antisemitic?
A. I don't think it's a simple question. I think this is a statement which has different levels of meaning to it.Q. Would you go forward, please, to tab 74?
This is more tweeting by Nick Land. This is in 2016. He says: "Fact. White subnormals are (ideologically) the niggers of the earth.
Also fact: they're white subnormals (Jewy machinations notwithstanding)." Then he says, "Of course they get a bum rap. The only people who will articulate that above the level of inchoate howl will be power-crazed hucksters." Then he says, "Going out on a limb here. I'm going to guess that it's the poor dim Jews who get disproportionately shoah'd". The reference to "shoah'd", that is a reference to the holocaust, is it not?
A. Yes.
Q. Is this an antisemitic series of statements by Mr Land?
A. I find it difficult again to interpret precisely what Nick Land is saying here. He is a very ironic writer. He is a very ironic writer. He is referring to elements in discourse using complex rhetorical techniques. I don't think he is saying these things in terms of his actual positions per se. he is referring to something. I don't really know what he is saying, to be honest.

People sometimes meet me in public places and speak freely. I get emails and messages to the same end (often anonymous). It’s very obvious that lots of people—particularly in the arts and academia–currently feel …

following has been established from the material that it before me,
including the material contained within the “Supplemental Bundle”:
a) Disclosure by the CAA following the court’s orders for disclosure
were: tweets to be found from p155 of the supplementary Bundle; An
example of Mr Silverman’s letter (see below);confirmation that Mark
Lewis was aa patron of CAA in 2018, who continues to provide advice
to it. The remaining disclosure followed research on behalf of RH.
b) The CAA was formed by Mandy Blumental, who is a member of its’
committee.
c) Mark Lewis was a patron of the CAA and has provided legal advice
to it.
d) Mark Lewis and Mandy Blumental were the individuals described in
the application for the summons as “A British Israeli couple”. I find
the failure to identify them and their close association with the
prosecutor as significant. The wording of the summary misled me into
believing that there was no such association, I am satisfied that this
was intentional.
e) Mark Lewis was fined by the Solicitors’ regulatory Authority on 13
December 2018. This was not disclosed at any point by the
prosecutor. Since he was one of those present at the Fringe show,
who objected to the joke, and subsequently disrupted the
performance, it should have been.
f) There is a report of Mark Lewis being criticised by Nicklin J on the
basis he had “put evidence before the Court, on an ex parte
application, that was not true” (p140 of the Supplementary Bundle)-
although it should be noted that the judge did not find that he had
knowingly misled the court. The judge reportedly stated that there
had been a “significant failure” by Lewis to comply with the general
obligation of full and frank disclosure (Mr Lawlor conceded that Mr
Lewis had been criticised albeit in the course of a property dispute).
This was clearly

Seeing Nina Power's spectacular dimwittedness playing out in court was quite something—exemplified here, where her *own barrister* asked her to explain why she'd lied in her pleadings about the Groyper accounts she was secretly running. Cross-examination saw her reduced to a sobbing, fascist husk.
Transcript from Liam Walker KC's re-examination of Nina Power during her High Court antisemitism libel trial:

Q. You have explained to us that you have made some mistakes in your document you signed.
A. Yes.
Q. You have been referred to the particulars of claim. You have had various statements made and questions not asked, but about how you have not disclosed things. Are you a lawyer?
 A. What? No.
 Q. Are you legally trained?
 A. I have an LLB but I'm not - from ages ago, but not, I'm not a lawyer.
 Q. How have you found this whole experience in terms of this litigation?
 A. A bit bewildering. A lot of this happened a long time ago and in fact lots of the attacks on me, it's difficult to remember which order they came in, to be honest. It feels like part of, you know, like an ongoing thing that has different moments.
 Q. Are you trying the very best you can?
 A. Sorry, yes, I really am trying.

This resulted in one of the most jaw-dropping moments at trial, when both DC Miller and Nina Power were forced by their own KC to admit to having made false statements in sworn statements of truth, having dishonestly claimed the groyper account Power used to target me was an "unknown third-party":
Daniel Miller being questioned by Liam Walker KC at the High Court:

I am not asking you to read it but that is your witness statement, and at the back, page 42 there is a statement of truth. Do you remember signing that?
A. Yes.
Q. Can I ask you now to go to tab 14, page 290? Do you have it?
A. Yes.
Q. It is item 6 on the left-hand corner. I will just read an aspect to you. "Item 6 is a reply by unknown third-party, DC Groyper". Can you read that?
A. Yes.
Q. Can I ask you to go to tab 13, so just go back from 290 to 287?
A. Yes.
Q. 287 and you can see that is your signature. Yes?
A. Yes.
Q. That aspect of item 6 which I read to you at 290, is that correct?
A. No, it's not correct.
Q. Is it true?
A. It's not true.
Q. Why did you sign something which you knew not to be true?
A. (no reply)
Q. There is no rush, Mr Miller.
A. I was dealing with the material very quickly and I was flustered by it. I also understood that it was not unknown - it was in fact Nina's account. I didn't want to drag the issue into it, which I didn't think was relevant. I regret that decision that I madeNina Power being questioned by Liam Walker KC at the High Court:

MR WALKER: And it is tab 30, first of all, and is that your witness statement?
A. Yes, it is.
Q. And if you go to the last page, in tab 30, is that your signature?
A. Yes, it is.
Q. Can I ask you to stay in that bundle and can I ask you to go behind tab 14, page 290? Do you have it?
A. Yes.
Q. Item 6, which is a reply by an unknown third party, DC Groyper, yes?
A. Yes.
Q. If you go to the previous tab, 13, the last page, 287, and it is a document signed by you?
A. Yes.
Q. Is that statement on page 290, is that correct?
A. No, it's not.
Q. And you have signed a statement of truth there. Why did you sign a statement of truth?
A. I think because I read this too quickly and I didn't notice that this was not accurate, so it's a mistake on my part, which I'm sorry for.
Q. Is it a mistake or is it a lie?
A. No, it's a mistake.

Since groypers are in the news, worth revisiting how antisemitic conspiracy theorists Nina Power and Daniel 'DC' Miller were exposed at trial as secretly operating a series of groyper accounts that they used to target me – including the 'Nina Power Groyper' and 'DC Groyper' accounts seen here:

The "alien races" Whatsapp messages certainly figured at trial, where both Miller and Power were reduced to tears by their own foolishness. Their responses were about as insightful as you'd expect…
Q. Well, that tweet there from Parallax Optics, the Holocaust one, was one of the ones which I think you admitted this morning was abhorrently anti-Semitic. Can we just turn, please, to the last reference in the WhatsApp messages for now? 3760 is the page, so it is back to bundle 5, tab 131.
A. I'm sorry, can you tell me the page again?
Q. 3760.
A. Uh-huh.
Q. Now, below the second hole punch, on 3760, this is 18th of August 2018 at 2143.
Ms Power says to you, "I wonder if the social disapproval for 'racism' is a psyop to stop people realising that there are alien and fairy races?" You say, "Good take."
A. Uh-huh.
Q. Then, if you drop down a few lines, Ms Power says, "Also, that black and white were alien races and very different." Then you say at the top of the next page, "Yes, you should not reveal this to most people. That's definitely true - they can't handle it."

Fascism aside, James Orr shows risibly poor judgment in characterising Nina Power as "a talented and valuable voice", when even her own barrister painted her at trial as a bumbling dimwit out of her depth, in a vain attempt to excuse the false testimony she gave about her anonymous Groyper accounts…

Special thanks to Naomi Siderfin and David Crawford for inviting me to be a part of the show ‘Manifesto for Sustainable Experimentation’, celebrating 30 years of Beaconsfield—whose magnificent archive has been acquired by the Tate, who I’m sure will cherish it for us all for many decades to come!
"I don’t think it’s pseudointellectual. I think it makes points. It has some language in it that is certainly not clear to a lay reader, whereas my manifesto is an artwork. It’s in some ways deliberately obtuse and playful with language, and it’s also very short. I think I say somewhere in my messages about the open letter that it - it is a shame it’s not more accessibly written, actually -
Q. Just going back to page 64, again in four, 289-93. This, ‘ In particular, we find a Third Positionist tenor - the dominant iteration and most creeping form of contemporary fascism. Third Positionist cryptofascism uses existing subcultural beliefs and lifestyles to promote pan-Europeanism, ultra-nationalism, and neo-colonialism, while cloaking its most unacceptable tenets. Yet, more worryingly, much of the esoterica discussed in the livestream also serves as the metapolitical backdrop and spiritual inspiration for some of the most violent far-right tendencies we’ve recently seen in Europe ’. That’s you and your mates, isn’t it?
A. Absolutely not. You -
Q. And this is part -
A. - I apol- can I just say -
Q. Please.
A. - having seen a distinction between that writing there -
Q. But it is a word salad, isn’t it?
A. I think that -
Q. Means nothing.
A. - I think that sentence you’ve read comes across as a bit of a word salad itself, so it’s hard to follow. I think if you break it apart, it does make sense, but it’s not - it’s not accessible. But if you compare that to the two open letters that I have published, I endeavoured to be clear in those, and that’s why I’m writing in the context of an open letter, to be as accessible as possible, which is contrary to my 2011 Metamodernist Manifesto, which is a very short and dense, playfully written, piece. Nothing I’ve ever written uses language in the way of that open letter that I’m being falsely accused of having a hand in.
Q. Your language is pompous, pseudointellectual and intentionally verbose, isn’t it? Do you agree?
A. No."

…and of contemporary Nazism, of being branded a ‘Degenerate artist’ in the 21st century, of having one’s freedom of speech quashed – and then the joys of enduring, of regaining artistic freedoms, of reclaiming one’s words, and of the luxury of time itself.
View of 'Cross-examination' wall text painting:

"Q. Now, pausing there, Mr Turner, you - I’m so sorry, I cannot remember if it was yesterday or today - but you used the words in your - in your statement, one of your criticisms of [the claimants] and others, is - is that the language they - they use was, I quote, ‘the language used by the DCXTV Account - and by many of the Twitter accounts with whom it was interacting, such as Depopulatus, ParallaxOptics and others - was pompous, pseudointellectual, and intentionally verbose.’ Those are paragraphs 128 and 119 of your statement, yes?
A. Yes.
Q. Now, help us with - with this, Mr Turner. Your Metamodernist Manifesto is a one-page document that can be found on the document, isn’t it?
A. Yes, it’s an artwork which was written in the style of early 20th century modernist manifestos. It is written in a particularly fanciful way. And yes, it uses unusual language.
Q. And I - I wonder if you can tell me, although it is only a page long, it has got eight points, but I will just go to point five, I think. ‘ All things are caught within the irrevocable slide towards a state of maximum entropic dissemblance. Artistic creation is contingent upon the origination or revelation of difference therein. Affect at its zenith is the unmediated experience of difference in itself. It must be art’s role to explore the promise of its own paradoxical ambition by coaxing excess towards presence.’ Seven, whilst we are here, ‘ Just as science strives for poetic elegance, artists might assume a quest for truth. All information is grounds for knowledge, whether empirical or aphoristic, no matter its truth-value. We should embrace the scientific-poetic synthesis and informed naivety of a magical realism. Error breeds sense.’ Your use of language, Mr Turner, the aspect that I read to you, which began ‘In particular we find Third Positionism…’ Similar, isn’t it?
A. I don’t agree with that. I agree that this open letter is verbose and quite pompous."

Just learned of the death of Walker Storz, a NRx Land acolyte whose article 'Toward a Hitlerian Disability Politics' figured in my trial against Nina Power and Daniel Miller. Storz, who wrote 'The Incel is the Only Possible Revolutionary Subject', also targeted me with abhorrent abuse.

James is indeed correct in anticipating that I made extremely reasonable offers throughout the litigation process that Mr Lewis's clients ought to have accepted, including this offer on the eve of trial to simply walk away from their hopeless libel claim bearing their own costs:
Dear Patron Law
(1) Daniel Miller and (2) Nina Power v Luke Turner
Claim No.: KB-2019-003691
We refer to previous correspondence in this matter.
We and our client are confident that he will successfully defend your clients' claims against him and that he will be similarly successful in his counterclaim against your clients. Nonetheless, our client is mindful of (i) the obligations on parties, under the Civil Procedure Rules, to try to resolve their disputes without a trial, (ii) the fact that substantial brief fees fall due imminently, and (iii) the potential benefits, in terms of costs and interest, of making an offer to settle. Our client is therefore prepared to make the offer set out in this letter in respect of your clients' libel claims against him only.
Terms of our client's offer This offer is made jointly and severally to your clients and is capable of being accepted by one or both of them.
Our client hereby offers the following terms in full and final settlement of the whole of each of your clients' libel claims against him as set out in your clients' Re-Amended Particulars of Claim dated 9 September 2021.The offer is as follows:
1. Within 14 days of accepting this offer, both of your clients shall serve a Notice of Discontinuance formally withdrawing their claims against him.
1. Each of the parties shall bear their own costs of your clients' respective claims (to be assessed if not agreed).
We look forward to hearing from you.
Yours faithfully

Insightful work here from James Wilson (@per-incuriam.bsky.social) who is continuing to shed much-needed light on Mark Lewis, the lawyer who represented far-right "bullies" Daniel Miller & Nina Power in my High Court case, and his concerning modus operandi: perincuriam2.substack.com/p/episode-8-...
The second case is Miller and Power v Turner [2023] EWHC 2799 (KB), where Mr Lewis acted for the claimants Daniel Miller and Nina Power in their defamation claim against Luke Turner. The case went to trial and Mr Lewis’ clients lost. What seems clear about this case is that the chances of Mr Miller and Ms Power succeeding at trial were very low. Mr Turner had made various statements about Mr Miller and Ms Power, including that they were fascists and neo-Nazis who had engaged in a campaign of harassment against him. Bizarrely, Mr Miller and Ms Power chose not to contest that they were fascists or neo-Nazis, but claimed their reputations had been harmed by the allegations of harassment. Given they had expressed admiration for Adolf Hitler, defending the fascism allegations would have been problematic to say the least. It seems unlikely that additional damage to their reputation was caused by the accusation of harassment on top of the accusation of being fascists? This seems to be the basis on which Mr Miller and Ms Power lost at trial. While I have no sympathy for Mr Miller and Ms Power, it seems possible that - as in my case - Mr Lewis’ conduct was motivated and the case maintained to trial on the basis of his own significant financial interests. It would be interesting to know if - as I did in my case - Mr Turner made a reasonable offer which Mr Lewis’ clients ought to have accepted, but which they were prevented from accepting because Mr Lewis advised against it. If that happened then - as with Mr Cantor - Mr Miller and Ms Power were obliged to carry on. They too may have been trapped in an aeroplane piloted by Mr Lewis. The end result was that Mr Miller and Ms Power lost at trial, they both went bankrupt and, presumably, Mr Turner was left out of pocket.

If I am right and Mr Lewis has been running cases on the basis of his own direct personal and significant financial interests, then this is a huge problem because other people - his own clients and those on the other side - will have suffered serious financial harm by his conduct. There is also the psychological harm caused intensely stressful and risky litigation. Given that Patron Law: (a) has effectively given Mr Lewis the authority to allow him to operate like this; and (b) appears not to have effectively supervised him; then it seems to me that (c) Patron Law and its insurers ought to be liable to those affected by Mr Lewis’ conduct. The cost of all this could run into £100,000s.
