I cannot get my head wrapped around how terrible an idea protecting individual headnotes is. If a headnote is not extremely similar - not just substantially, extremely - to the language it relates to, it is literally worse than useless. Protecting them is utterly bonkers.

For some reason there’s this assumption that the AI must be so smart we just can’t understand. The simpler and therefore far more likely explanation is that “She just named the synthesis – demurrage plus oral memory equals a valve that can’t be ghosted” is just complete bullshit.

Neuroscientist here. I have studied the brain for 40 years. I make serious use of machine learning and AI in my research. Sam Altman is full of shit. These machines are not conscious, any more than a movie of a train coming out of the screen is a train. AI does remarkable things but isn’t real.

I find it absurd that the em dash is now widely perceived as an indicator of AI use. I have used it since childhood; it is part of my writing style. Sometimes inserting a brief aside within a sentence, at other times emphasizing the conclusion of a thought.

And there is the even more insidious problem that if working from a prior draft, no matter who or what wrote it, that tends to limit creativity because people hesitate to depart from what they see as the “approved” or “correct” arguments. Especially new lawyers.

Right. I keep hearing that using AI is supposed to save time, but it could only do that if you accept its output, which in the legal profession you absolutely cannot do. If you have to check everything personally anyway, why didn’t you just do the work to begin with?
