I don’t think this the hill you want to die on. The underlying case was Elon Musk’s effort to overturn the MN law banning AI generated non-consensual nudes. Twitter isn’t just a platform hosting content—Grok is a tool offered & heavily promoted by Twitter. Applying 1A & 230 misses the point.

To clarify, Mike didn’t think the broader statute banning all non-consensual NC was permissible under 230 or 1A. I and others, moved into how current 1A wasn’t doing a good enough job of addressing CSAM & we weren’t happy with his response.

Dude not only is she right, but you’re failing to pick up on the factual nuances in her hypo. The inquiry being the next day vs. immediately afterward on the scene makes a huge legal difference. Just pack it up.
