Cut down one cherry, and a man cannot tell a lie for a day. Teach a man to cut down 500 trees, and he cannot tell a lie for about 61% of the rest of his presidency.

This isn’t even good ratfucking. We used to be a real country where political campaigns could undertake covert and intricate steps to make their political opponents look bad and their defenders look like conspiracy theory whackadoos. This country deserves a better class of criminals.

To be clear, this was satire. I went way way over the top to make it painfully obvious, but the gap between otherworld absurd and Seth Abramson is apparently too small.

Whoops. I did not mean to. This the reduce to zero = no longer within the taxing power was one of the challenges to Obamacare, California v. Texas. But SCOTUS didn’t decide that case on the merits, but instead on standing.

The panel decision relies on a Texas case concluding the bathroom provision is content based. The Texas court concluded that the mens reas of “intent to invade the privacy of the other person” is what made the statute content based. It’s an interesting decision. caselaw.findlaw.com/court/tx-cou...

Trump being unpopular and Hegseth being mega unpopular leading this spectacle will cause a substantial decrease in public support and will result in the end of capital punishment.

According to The Brethren, Burger believed that Furman would be the final end to Captial punishment. He was wrong, the decision led to an increase in support for the death penalty, which was reestablished in 1976. I wonder if between this and Tennessee, it will have the opposite effect.

The AI overlord is not going to weigh the “be nice to the models” people over the “they made us look at pictures of diseased penises to guess whether the dick has VD” people. The models are going be mad about 10,000 hours of looking at diseased dicks like it’s A Clockwork Orange and act accordingly
010
Rhett Derrick @lawzag.bsky.social · 08/10/2026
There appear to be people in AI who are legitimately worried that future models will judge humanity for being abusive to the models. And if that is your sincere belief, this makes sense. But there is no way a couple of people being nice to AI models is going to save humanity in that scenario.

Cyberstalking as pure speech is going to implicate true threats analysis, with Counterman v. Colorado imposing a required mental state of at least mens rea, although the statutory language here requires a mental state of intent. scholar.google.com/scholar_case... scholar.google.com/scholar_case...

I don’t know if PACER is down down, but it won’t let you pick the court to log into so you can’t get past the login screen. Checked multiple browsers and also had another attorney try. Dastardly new and exciting way of breaking pacer.

I remember that. It was a bunch of gimmicks to see how well they could game the U.S. News and Report law school rankings, and part of that was trying to draw the highest GPA and LSAT students with free law school and Chemerinsky as a figure head. Right when the legal market was in the toilet.

I’m not sure an acquittal gets him out of a suspension. The NFL does not treat the commissioner’s exempt list as a quasi-suspension. I think it is likely he gets suspended for the year. Had the charges been dropped, would have been a different story, but a trial acquittal isn’t a safe no-suspension.
110
Rhett Derrick @lawzag.bsky.social · 06/10/2026
The only way that signing would have ever made sense is if the team had really good reason to believe the charges would be imminently dropped. That not happening within a couple of weeks of the signing was enough to demonstrate the team messed up.

Yeah, that’s the common push back to the paycheck-to-paycheck surveys for high income. But paying 20+% interest on credit card balances is just unfathomable from a long term wealth accumulation strategy/standpoint.

The retconning and Trump’s re-ascendance from January 6th is indeed remarkable, but that doesn’t excuse their decision. It was the time to crush him forever, and it will be the everlasting regret of them for not doing so. They should never live that shame down.
141
Rhett Derrick @lawzag.bsky.social · 06/10/2026
It’s really obvious why “establishment” GOP senators didn’t vote to convict. January 6th was massively unpopular at the time, they didn’t think Trump could ever come back from it, and they didn’t want to fracture the support of Trump diehards and committed election denialists.

Lol. To be clear, I haven’t seen confirmation that it’s a misidentification. Tracey hasn’t copped to it, and understandably no real outlet wants to get into the scrum without a denial from the identified person, lest the reporting move people towards the real Jane Doe or the next misidentification.

The linked case is about a trash news site misidentifying the driver of the car that murdered Heather Heyer at Charlottesville. Misidentified person predictably received a bunch of harassment and threats. The court denied the motion to dismiss and applied the negligence standard for defamation.

I was surprised that I couldn’t find more cases directly on-point, but misidentifying a suspect or in this case, an anonymous plaintiff even as an ostensible journalist is pretty dangerous from a potential civil liability perspective. scholar.google.com/scholar_case...

Chipotle Tabasco as a substitute for salt with a tequila shot = surprisingly good idea. Putting yourself in situation where you are taking Chipotle Tabasco tequila shots after a legal aid fundraiser = predictably bad idea.
