CAN-SPAM sets a floor. When expanding into other countries, they will have their own floors. Build to the stricter standard and you will be on the right one. www.spamtacular.com/2026/05/26/emai…

CAN-SPAM is the floor, but it’s only one floor
CAN-SPAM compliance and international compliance are not mutually exclusive. CAN-SPAM sets a floor. And so does every other jurisdiction. Where the foreign floor is lower than or equal to CAN-SPAM’s, a CAN-SPAM-compliant program has no gap. Where the foreign floor is higher, a program built to CAN-SPAM’s standard may have a deficit it does not […]

CAN-SPAM says you can email people who haven't asked. GDPR, PECR, CASL, and Australia's Spam Act say you can't. The gap isn't a technicality — it's a philosophical divide about what privacy is. New post: www.spamtacular.com/?p=4311 #emailmarketing #privacy #GDPR

Your US Email Compliance Assumptions Are Wrong Outside the US
The United States treats commercial email as opt-out by default, an approach that puts it at odds with email marketing laws outside the US. You may email someone who hasn’t asked for it, and CAN-SPAM permits that as long as you identify yourself, include a physical address, and honor unsubscribe requests. That framework has shaped […]

The From address in an email carries no inherent authentication. SPF doesn't verify it. DKIM breaks when the message hits a mailing list. DKIM2 fixes the chain of custody problem — and changes what forensic experts can offer in litigation. New on Spamtacular.: www.spamtacular.com/?p=4306

Authenticating Email Evidence Gets Harder to Contest
Authenticating email evidence often presents a problem that most counsel underestimate if the opposing party refuses to agree to authenticity. The From address visible in a message carries no inherent authentication. Under Fed. R. Evid. 901, courts require the proponent to establish that the communication was sent by the person it appears to be from. […]

The SECURE Data Act is the strongest U.S. privacy bill ever introduced. It doesn't fix the EU adequacy problem. FISA Section 702 is still the wall, and comitology runs through 27 member states whose relationships with Washington are strained.

The SECURE Data Act Moves the Needle, Not the Bar
On April 21, 2026, Representative Joyce of Pennsylvania introduced the Securing and Establishing Consumer Uniform Rights and Enforcement over Data Act (the “SECURE Data Act”) in the House Energy and Commerce Committee. If enacted, it would be the most significant federal consumer privacy statute in U.S. history. It would not move the United States materially […]

Are You a VPPA Video Tape Service Provider?
Embedding Video on Your Site Does Not Make You a VPPA Video Tape Service Provider Salazar v. Paramount Global, now before the Supreme Court, resolves only one element of a multi-element statute. It is not the element that determines whether the Video Privacy Protection Act (VPPA) applies to your email marketing program. If Salazar wins, […]

I think the absolute best part is where he explains that the same properties whose values he was accused of inflating in the trial are certainly worth more than enough to satisfy the judgment so it's totally okay to waive the bond.

Am I the only one who finds this bit ironic... given that he was accused of inflating the value of his property? "'Defendants’ real estate holdings — including iconic properties like 40 Wall Street, Doral Miami, and Mar-a-Lago, — greatly exceed the amount of the judgment,' the filing said."

Trump has been unable to get bond for $464 million judgment, his lawyers say
In a filing to an appeals court, Trump's attorneys said getting the bond needed to halt proceedings while they appeal is a "practical impossibility."

"Can you negotiate with this company on my behalf to get my money back?" is not a thing that I can do until AFTER I get my law license. Don't get me wrong: That company has definitely opened 2 accounts and is double charging for a single service. But, I've gotta pass the bar before I can do that.
