I want to fold this into another religion case that the Supreme Court is about to hear, Oklahoma Statewide Charter School Board v. Drummond, in which—well, tell me if I have this right: The court will decide whether the First Amendment requires Oklahoma to fund a religious charter school run by the Catholic Church?

To state the question should be to answer it. Yes, that’s the question the court will answer. Of course, there was never any circuit split on this; there should be no difficulty answering this question whatsoever. The fact that the justices took it up anyway—even when Justice Barrett is recused—should terrify everybody about where this is headed, because the combination of these two cases is going to be a real one-two punch for public education. The rules may soon be that a state has to provide, fund, and support religious education. Meanwhile, it cannot provide public education in secular schools that religious parents object to. That would require a dual system of religious education or religiously approved education. And that is just not how public education can operate.
