The panel’s 2-1 ruling mandated that Chief Judge Boasberg end his criminal contempt inquiry into the brazen violation of his order not to remove Plaintiffs to El Salvador—a violation that resulted in Plaintiffs being subjected to months of abuse and torture at the notorious CECOT prison. Op. 2-3. The panel preemptively decided that the district court’s order was ambiguous and could not therefore support a criminal contempt finding, even though the government lawyers handling the case stated that they understood the order. The panel also concluded that the district court could have referred the matter for prosecution based on the information in its possession and that seeking any further facts was clear error. But even if the district court were barred from seeking additional information (which it plainly was not), the panel’s principal holding that the order’s supposed ambiguity precludes criminal contempt now means that the district court is barred from even making a referral. The panel’s ruling has thus shielded Defendants from further inquiry into their actions, whether by a prosecutor or the district court.

In competitive authoritarianism, leaders abuse state power to tilt the electoral playing field in their favor, manipulate the media environment and minimize opposition voices, maybe even steal close elections by lying about fraud. But they usually can't overcome a large majority voting against them.

Some of the stories in here are absolutely chilling. One US citizen of Somali descent was just riding an elevator with ICE agents and then they detained him for almost half an hour in the freezing cold despite him showing agents his passport card. They only let him go once protestors showed up.
Defendants’ Unlawful Detention of Ali Dahir 49. Ali Dahir is a U.S. citizen of Somali descent who has lived in the United States since 2001. He currently resides near Karmel Mall, in a neighborhood with a large Somali American population in Minneapolis. On December 2, 2025, Mr. Dahir was leaving his apartment when he observed uniformed officers wearing vests and masks knocking on doors in his building. Mr. Dahir was detained after sharing an elevator in his building—a building primarily housing residents of Somali and Latino descent—with the ICE agents. Mr. Dahir did not speak to or otherwise engage with the agents while in the elevator. When Mr. Dahir exited the elevator and walked outside, the agents followed him,
called him over, and stopped him, saying that they needed to speak with him. 50. The agents took a picture of Mr. Dahir’s face with their phone and asked him for his identification. Mr. Dahir provided them with his Minnesota driver’s license. They asked Mr. Dahir if he was a U.S. citizen, and when he responded that he was, they demanded proof. Mr. Dahir provided his passport card, but the agents still did not let him leave. Instead, they took his driver’s license and passport card to their car. Mr. Dahir asked if he was free to go, but an officer said no because they were waiting for more information from their headquarters. The agents kept Mr. Dahir outside for at least 25 minutes in weather at or below 19 degrees Fahrenheit. When Mr. Dahir asked if he could leave to go to work, the agents told him he was not free to leave and threatened him with detention. 51. The agents also held a friend of Mr. Dahir’s. The ICE agents prevented Mr. Dahir and his friend from leaving until media and other people from the neighborhood started to gather, at which point one of the ICE agents stated, “It’s getting hot over here, let’s go, let’s go.”

A federal judge last week blocked ICE from making indiscriminate arrests without a warrant in Colorado, in a case brought by @acluofcolorado.bsky.social.  The Trump administration can't arrest people because of our skin color, accent, or perceived nationality in order to fulfill arrest quotas.

THREAD: Judge Ellis is the first federal judge to review extensive body cam video of DHS's actions in Chicago. She finds that DHS *repeatedly* misled the public and made claims that were disproven by agents' own videos. I'll go through some of the most egregious ones here.
II. Credibility
The Court next addresses the credibility of the parties’ evidence and witnesses. After reviewing all the evidence submitted to the Court and listening to the testimony elicited at the preliminary injunction hearing, during depositions, and in other court proceedings, the Court finds Defendants’ evidence simply not credible. [FN 6]

Plaintiffs submitted a mountain of evidence, providing the Court with over eighty declarations, numerous videos and articles, and other evidence. Defendants did not rebut anything that Plaintiffs set forth in their declarations or testimony, even with BWC footage. 

[FN 6] In another case considering some of the same evidence presented to this Court, another court in this district also found that the perceptions of certain of Defendants’ declarants, such as Hott and Parra, were not reliable. See Illinois v. Trump, No. 25-cv-12174, 2025 WL 2886645, at *5 (N.D. Ill. Oct. 10, 2025) (noting a “troubling trend of Defendants’ declarants equating protests with riots and a lack of appreciation for the wide spectrum that exists between citizens who are observing, questioning, and criticizing their government, and those who are obstructing, assaulting, or doing violence”), motion to stay denied in part, 155 F.4th 929 (7th Cir. 2025).
