This emergency application asks the Court to stay the Ninth Circuit's appellate
mandate, which is expected to be issued as early as Friday, July 24, 2026. Absent interim relief, the Ninth Circuit's mandate enforcing the NLRB's order in this matter
could permanently obstruct further review. The Ninth Circuit has wrongly enforced a Board order setting aside a union election based upon unfair labor practices that allegedly occurred nearly eight years ago. A majority of employees voted against the Union in 2019, but the appeals court purported to rely on the Supreme Court's holding in NLRB v. Gissel Packing Co., Inc., 395 U.S. 575 (1969) to uphold a bargaining order without any new election. Circumstances have changed dramatically since the previous election, reflecting the passage of time and turnover
well above 50% in both the work force and management. But the Ninth Circuit -
alone among all the circuits - has held that changed circumstances are
"irrelevant" to enforcement of the bargaining order. (App. 30a).Every other circuit has interpreted Gissel to require consideration of the
passage of time and employee turnover when a bargaining order is sought from the
appeals court. Except for the Ninth Circuit, every circuit has found changed
circumstances relevant. Absent this Court's grant of a temporary stay to allow a
certiorari petition to resolve the entrenched conflict between the Ninth Circuit and
every other court of appeals, the majority of the employer's current workers at the
applicable worksites will be disenfranchised, having no chance to vote on union
representation. And as discussed more below, CEMEX has identified other circuit
splits relevant to this case as well.
The Ninth Circuit has denied CEMEX's motion in that court for stay of the
appellate mandate. Unless this Court grants temporary relief, the NLRB claims the
right to enforce its orders, subject to contempt proceedings, even while CEMEX
petitions this Court for certiorari. The extraordinary changed circumstances in this
appeal require the Court's intervention, both to prevent irreparable harm to CEMEX
and its employees, and to protect the Court's certiorari jurisdiction. The relief
CEMEX seeks is limited and straightforward: stayed enforcement of the mandate
pending the filing and disposition of CEMEX's petition for writ of certiorari.

The federal government last week launched a new website for the Homeland Security Task Force. The lead image on the site is a phalanx of armed agents wearing police vests, camouflage and gas masks with the header, “We don’t negotiate. We dismantle.”

On the website, the agency says there are now task forces covering every state, with one of the more than two dozen “core headquarters” in the Twin Cities area. The website says the task forces don’t enforce civil immigration laws, but the task forces have faced scrutiny for actions critics said largely seemed to target immigrants, including a raid on a cockfighting operation last June that the agency said netted “55 illegal aliens.”

The task forces were created under an executive order in January 2025, in the early days of President Donald Trump’s second term, under the heading "Protecting the American People Against Invasion."

The order outlines the creation of local and federal collaborations to combat criminal cartels and transnational criminal organizations. It also explicitly states that the task forces will “dismantle cross-border human smuggling and trafficking networks, end the scourge of human smuggling and trafficking, with a particular focus on such offenses involving children, and ensure the use of all available law enforcement tools to faithfully execute the immigration laws of the United States."
